Appendix ‘A’ Gem Lake Consolidated Land Use Ordinance Definitions Updated 10/19/2023 Page 3 <br />Building Type Templates - Figures 6 through 15 are the Building Type Templates of the Gateway District. These templates contain all <br />regulatory information governing the dimensions of lots and the dimensions, setbacks, height, placement and use of buildings in the <br />Gateway District. The Terms and concepts used with the Building Templates are further defined in Sect 9.5.2 of the Gateway District <br />section of the City of Gem Lake Zoning Ordinance. <br />Bungalow Court - Four or more smaller, standalone homes around a shared central court or walk on a single lot, with pedestrian access <br />to the street. Note - This is Building Template 10 for the Gateway district. <br /> <br />Canopy - A freestanding permanent roof-like shelter no attached to or requiring support from an adjacent structure. <br /> <br />Carport - An automobile shelter having one or more sides open. <br /> <br />Changeable Copy - The letters, symbols, logos or other graphics which make up a sign’s communicative message, if they are placed <br />on the sign by electronic or electrical means (a message center or dynamic display) or which can be replaced manually through use of <br />letters and symbols in a panel mount or track system. <br /> <br />City Architect - The City Architect is appointed to review all applications requiring evaluation of the Design Standards in Section 10.7 <br />of the Gateway District. If deficiencies are noted, the City Architect shall describe the deficiency and suggest at least one complying <br />alternative. <br /> <br />City Council - The City of Gem Lake City Council. <br /> <br />City Forester - A forester appointed by the City of Gem Lake. <br /> <br />Clean Water Act - The federal Water Pollution Control Act (33 U.S.C. § 1251 et seq.), and any subsequent amendments thereto. <br /> <br />Clustering - A grouping of residential or other structures arranged without regard to normal lot lines and set -backs but with the express <br />intent of preserving open spaces and natural resources for community use, establishing a sense of community among owners/resi dents <br />and reducing the cost and impact of infrastructure development and service delivery. <br /> <br />Cold Frame - An unheated outdoor structure with a frame of wood or similar material and a top of glass or clear plastic, used for <br />protecting seedlings and plants from the cold. <br /> <br />Commercial Broadcast Services - Licensed commercial radio or television services transmitting signals for reception by the general <br />public. <br /> <br />Commercial Wireless Telecommunications Services - Licensed commercial wireless telecommunications services including cellular, <br />personal communications services (PCS), specialized mobile radio (SMR), enhanced specialized mobilized radio (ESMR), paging a nd <br />similar services that are marketed to the general public. <br /> <br />Community Garden - An area of land managed and maintained by a group of individuals to grow plants and harvest food crops for <br />personal or group use, consumption or donation. Community gardens may be divided into separate plots for cultivation by one o r more <br />individuals or may be farmed collectively by members of the group, and may include common areas maintained and used by group <br />members. <br /> <br />Coniferous/Evergreen Tree A woody plant which, at maturity, is at least thirty (30') feet in height, with a single trunk, fully branched <br />to the ground, having foliage on the outermost portion of the branches year round. <br /> <br />Construction Activity Means activities including clearing, grading, and excavating, that result in land disturbance of equal to or <br />greater than once acre, including the disturbance of less than one acre of total land area that is part of a larger common plan of <br />development or sale if larger common plan will ultimately disturb equal to or greater than one acre. This includes a disturba nce to the <br />land that results in a chance in the topography, existing soil cover, both vegetative an d non vegetative, or the existing soil topography <br />that may result in accelerated stormwater runoff that may lead to soil erosion and movement of sediment. Construction activit y does not <br />include a disturbance to the land of less than five acres for the purp ose of routine maintenance performed to maintain the original line <br />and grade, hydraulic capacity, and original purpose of the facility. Routine maintenance does not include activities such as repairs, <br />replacement and other types of non routine maintenance. Pavement rehabilitation that does not disturb the underlying soils (e.g., mill <br />and overlay projects) is not construction activity. <br /> <br />Contiguous Areas of real property actually in contact with one another or touching along a boundary and also touching or connected <br />throughout in an unbroken sequence. Real property separated by a body of water or designated wetland shall not be considered <br />contiguous regardless of whether the real property under the body of water or wetland has common ownership. <br />The routing of a driveway through a parcel of real property shall not be considered as separating same so as to make the port ions created <br />by the driveway not contiguous.
