Conditional Use Permit Request for 1599 County Road E East <br />Gem Lake Planning Commission 8/12/2025 <br />August 1, 2025 <br />Page 4 <br /> <br /> <br /> <br />Ordinance No. 131, Consolidated Land Use Ordinance, regulates Conditional Use Permits in Section 17.5. When <br />reviewing a Conditional Use Permit application, the following criteria shall be reviewed and measured by the <br />Planning Commission and City Council (17.5.2.1): <br /> <br />1. Adjacent Uses <br />2. Air and Water Quality <br />3. Traffic Generations <br />4. Public Safety and Health <br />5. Area Aesthetics <br />6. Economic Impact on the Entire Area <br />7. Consistency with the Comprehensive Municipal Plan <br />8. Anticipated Duration of the Conditional or Interim Use <br /> <br />This is an application related to illumination. The Commission’s recommendation should not take signage size, <br />design, or location into account. The criteria are listed below in italics, followed by a staff evaluation that focuses <br />on the effect of the "soft, low lumen, LED lamps" in the sign. <br /> <br />1. Adjacent Uses <br />This criterion is met. Adjacent to this [property is a County roadway, additional business including a gun shop, two <br />restaurants, a dance school, and a wooded area near the railroad tracks. The propsoed illumination does not <br />appear to impact adjacent uses. <br /> <br />2. Air and Water Quality <br />This criterion is met. An illuminated sign would not be expected to impact air and water quality. <br /> <br />3. Traffic Generations <br />This criterion is met. An illuminated sign would not be expected to generate additional traffic that wouldn’t be <br />traveling to “the Lakes Dispensary” without an illuminated sign. <br /> <br />4. Public Safety and Health <br />This criterion is met. An illuminated sign would not be expected to impact public safety and health. <br /> <br />5. Area Aesthetics <br />This criterion is met. An illuminated sign could impact the area aesthetic positively, as many enjoy the look. The <br />view from adjacent properties would not be greatly impacted due to the uses in the area. <br /> <br />6. Economic Impact on the Entire Area <br />This criterion is met. An illuminated sign would not be expected to have an economic impact on the entire area. <br /> <br />7. Consistency with the Comprehensive Municipal Plan <br />This criterion is met. Illuminated signage is not explicitly mentioned in the 2040 Comprehensive Plan. LED <br />illumination does not contradict any Comprehsnive Plan goals. <br /> <br />8. Anticipated Duration of the Conditional or Interim Use <br />This criterion is met. There would be no anticipated dissolution of the conditional use. Conditional uses, if <br />discontinued for 6 months, are considered void. <br /> <br />
