<br /> <br />CITY OF GEM LAKE, MINNESOTA <br /> RESOLUTION NO. 2025-030 <br /> <br />A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR <br />3646 LABORE ROAD, PID 283022440005 <br /> <br /> WHEREAS, , Jeff and Nikki Foley, applicants on behalf of the Carole M. Schilling Trust <br />and Carole M. Schilling, Trustee, the property owner(s) made an application to request a <br />Conditional Use Permit to allow for a home occupation using more than 50% of the residence to <br />provide appointment-only financial services located at the property listed above; and <br />WHEREAS, the Planning Commission reviewed the request at a duly noticed public hearing on <br />October 7, 2025, and determined that the proposed request did not meet the criteria approval, and <br />voted to recommend denial of the request with findings for denial; and <br /> <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL <br />OF GEM LAKE, RAMSEY COUNTY, MINNESOTA, that it should and hereby does direct <br />staff to approve the Conditional Use Permit to allow for the home occupation located at the <br />property addressed as 3646 Labore Road. <br /> <br />FURTHER BE IT RESOLVED that the following conditions of approval shall be met: <br /> <br />1. The applicant shall submit for a residential building permit per the floor plans submitted to <br />the City on 09/18/2025 and reviewed with this application. <br />a. The applicant shall revise their plans submitted 09/18/2025 to demonstrate that the <br />home occupation will be secondary and incidental to the primary residential function <br />of the property. <br />2. No non-residential employees may leave their vehicles on-site outside of business hours and <br />no vehicles associated with the business are allowed to be parked on the street, block <br />sidewalks, or public easements. <br />3. The applicant shall adhere to all applicable local, State, or Federal regulations. <br />4. The applicant shall acquire any other applicable local, State, or Federal permits for this <br />request. <br />5.
