<br /> <br /> <br /> <br /> <br />CITY OF GEM LAKE, MINNESOTA <br /> RESOLUTION NO. 2025-32 <br /> <br />A RESOLUTION DENYING A SPECIAL HOME OCCUPATION LICENSE FOR <br />3646 LABORE ROAD, PID 283022440005 <br /> <br /> WHEREAS, Jeff and Nikki Foley, applicants on behalf of the Carole M. Schilling Trust <br />and Carole M. Schilling, Trustee, the property owner(s) made an application to request a Special <br />Home Occupation license to allow for a home occupation to provide appointment-only financial <br />services located at the property listed above; and <br /> <br /> WHEREAS, the Planning Commission reviewed the request at a duly noticed public <br />hearing on October 7, 2025, and determined that the proposed request did not meet the criteria <br />approval, and voted to recommend denial of the request with findings for denial; and <br /> <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL <br />OF GEM LAKE, RAMSEY COUNTY, MINNESOTA, that it should and hereby does direct <br />staff to deny the Special Home Occupation license to allow for the home occupation located at <br />the property addressed as 3646 Labore Road. <br /> <br />FURTHER BE IT RESOLVED that the following findings for denial are made: <br /> <br />1. No traffic shall be generated by a home occupation in greater volumes than would normally <br />be expected in a residential neighborhood. The need for off-street parking shall not exceed <br />more than three off-street parking spaces for the home occupation at any given time, in <br />addition to the parking spaces required by the residents. <br />a. A variance application has been made to increase the number of off-street parking <br />spaces for the home occupation beyond the maximum of three spaces to <br />accommodate up to 20 parking spaces for 14 full-time and part-time employees and <br />six (6) customers. Additionally, the business anticipates operating through <br />appointments-only, so no walk-in or unscheduled activity is anticipated. <br />2. No more than one non-resident employee shall be allowed to work on the premises at one <br />time. Nonresident employees who work off the premises may be allowed to visit the <br />premises. If an on-site employee is parking on site, off-site employees shall not leave their <br />vehicles on site. If there is no on-site employee vehicle parked on site, one off-site employee <br />vehicle may be parked on site. <br />a. The applicant has submitted a variance application to increase the number of <br />nonresidential employees from the maximum of one to no more than 14 full-time and <br />part-time employees. As a condition of approval, no non-residential employees may <br />leave their vehicles on-site outside of business hours.
