City of Gem Lake <br />County of Ramsey <br />State of Minnesota <br /> <br />Resolution No. 2024-0019 <br /> <br />APPROVING A MINOR SUBDIVISION FOR 3610 HIGHWAY 61 AND 3700 <br />HIGHWAY 61, PID 273022430031 & PID 273022430019 <br /> <br /> WHEREAS, Barnett Properties, the owner of both parcels, made an application to <br />request a minor subdivision to allow for a lot line adjustment of the lot line between the two <br />properties listed above; and <br /> <br /> WHEREAS, the properties are currently legally described as follows: <br /> <br />See Attachment A; and <br /> <br /> WHEREAS, the Planning Commission reviewed the request at a duly noticed public <br />hearing on August 13, 2024, and a duly noticed meeting on September 10, 2024, and determined <br />that the proposed request meets the criteria for a minor subdivision, and voted to recommend <br />approval of the request with conditions; and <br /> <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL <br />OF GEM LAKE, RAMSEY COUNTY, MINNESOTA, that it should and hereby does <br />approve a minor subdivision request to allow a lot line adjustment of the lot line between the two <br />properties addressed as 3610 Highway 61 and 3700 Highway 61, based on the following <br />findings: <br /> <br />1. The request would not create any new lots, and no new street or extension of facilities is <br />necessary. The lot line adjustment would result in both parcels being compliant with the <br />requirements of Ordinance 131, and the request would be consistent with the City’s 2040 <br />Comprehensive Plan. <br /> <br />FURTHER BE IT RESOLVED that the following condition of approval shall be met: <br /> <br />1. The proposed lot line adjustment between 3610 Highway 61 (Parcel ID 273022430031) <br />& 3700 Highway 61 (Parcel ID 273022430019) shall adhere to the dimensions as <br />proposed in the plans submitted to the City on 7/23/24 and reviewed with this request. <br />2. The proposed lot line adjustment shall include new legal descriptions for each parcel. <br />3. The applicant shall dedicate a drainage and utility easement along the proposed realigned <br />lot line, and around the storm sewer line. Said easement shall be at minimum 10 feet in <br />width. <br />4. The applicant shall dedicate an access easement to allow the north parcel (3700 Highway <br />61) to have continued access to Highway 61. <br />5. The applicant shall record the lot line adjustment with Ramsey County within one year of <br />the date when the request was approved by City Council. <br />a. The applicant shall submit a revised survey to the City for review showing that <br />conditions 1, 2, 3, and 4 are met prior to recording. <br />6. The applicant shall adhere to all applicable local, State, or Federal regulations.
