<br />Section 3. Moratorium.
<br />I. NO individual, establishment, organization, or business. may engage in the retai1.saIel wholesale sale, testing, growing,
<br />cuItivating,.manufacturing, transporting; delivery of`or distribution:of CannabisTroducts, including products using any
<br />parfof the pi ant of.the genus Cannabis plant;.containirig cannabis concentrate; infused With camatiinoids (incltding but
<br />not Iimited to tetrahydrocan nabinol); extracted...or der ived.froin cannabis plants a can n ab i s. Nwer; synthetically
<br />derived can n ab ino id s, or lower potency hemp edibles that contain more .than 0;3% of Tetrahydro Conn abi no 1, before
<br />January 1, 2025.

<br />3. This moratorium does not apply to these testing,manulacturing, or distribtit ing of CannabisProd ucts related to
<br />the Medical Cannabis Program as administered.bythe Minnesota Department of Health; provided that such activity i
<br />done 1n accordance with the regulations and laws 0fMinnesota.rcgarding.Medical. Can nabis.

<br />Section 4. Study. The City Council directs City.staIT'to.study the. need for loca.i regulatioit regarding the.: retail sale, wholesale
<br />sale, testing, growing, .cu.Itivat ing, manufacturing; transporting, delivery or distribution oFCannabis:Products listed in Section
<br />3(A} herein within.thc City.oFGem Lake: Staff must also study the:need fbr creating or amending zoning ordinances; Iice tising.
<br />ordinances,. as aIIowe d'by the. state, or any other ordinances, as allowed and not preempted by the state, to protect the citizens of
<br />Gem I:ake front any potential negative impacts.. Upon completion of th e. study,. the City Council, together. with such corn missidn
<br />as the City Council deems appropriate or, as.m.aybc required by law, WiIf consider the advisability 0fadopting new :o rd in ance s or
<br />amending its currcnt.ordmances
<br />Section 5. E nfercement. The .City may enforce this.Ordinonce bymandamus, injunelive relief. or other appropriate civil remedy
<br />in any court of coimpetentjurisdietion. The City. Count iI lid reby authorizes theAdministrator;.CIerk/Treasurer,. in consultation
<br />with the City. Attorney, to. initiate any lcgal.action deemed necessary to secure compliancewith thisOrdinance, A violationof
<br />this .Ordinance is also subject to the Cily's general penalty.
<br />Si:ction G. Term. Unless earlier rescinded by the City Council; the moratorium established under this Ordinance shaft remain in
<br />elFect until January 1, 2025. The City Council hereby el eels that all legally toinpliant portions of this Ord iitancc. be extended: for
