Pax GU Staff Report Septernber 20, 2022. <br />f Gem Lake City Council Page.5 <br />4) Public Safety and Health <br />The proposedproject should not have impacts on the safety or health of the public. <br />5) Area Aesthetics <br />The proposed use is pot a common occurrence in the city, so it would stand out in comparison to <br />other neighboring properties. The sitemas previously.used tohouse horses, with the barn still <br />remaining on site. The applicant is proposing a fenced -in area fortheir two goats to graze in east <br />of the barn. If there are concerns with the proximity of the area towards the neighbors to the <br />south, a condition to shift the fenced -in area:further.north could be.a .condition of approval: <br />6) Economic Impact on the Entire Area <br />N/A, the proposed use does not have an economic impact on the area. <br />7) Consistency with the Comprehensive Municipal Plan? <br />Farm animals and their containment are not mentioned in the 2040 Comprehensive Plan. <br />Provided that zoning requirements and other municipal ordinances are met, .the proposed project <br />would be consistentwith the Comprehensive Plan. <br />8) Anticipated Duration of fhe Conditional or interim Use <br />As a conditional use; the proposed structure would be intended to -be used for a considerable <br />amount of time.. If approved as an interim use, an end .date. could be set by the city. The. <br />Commission recommended one year, to see if issues or nuisances arise from. the use. <br />17 5.9(8) <br />7} Compliance with all zoning and other regulations as may otherwise be applicable; <br />Farm animals are able .to be permitted on parcels over an acre in size, and would be. required to <br />comply with all other applicable focal; State, or Federal regulations. The barn is nonconforming to <br />today's agricultural setback requirements, so it is unabl&to be expanded. If approved,. conditions: <br />of approval regarding. screening, fence standards, and prevention of nuisances are appropriate_ <br />2) The. date or the. event that will terminate the use can be identified with certainty; <br />As. a: conditional use, this requirement is NIA. If approved as an interim use, an end date can be <br />set. <br />3) The existence of the Conditional or Interim Use will not impose 'additional. costs on the public if it <br />becomes necessaryfor the public to take the property in the future; <br />In the..event of thepublic taking the, property in. the future, the presence of the proposed use <br />should not: impose. additional costs onto the public. <br />4) The user agrees to any conditions of approval associated with the approval of the Conditional or <br />Interim Use Permit by the City Council. <br />The ccnditions.:recornmended by the Commission were approved by the applicarif. <br />17.5.9(C) <br />1) Shall maintain harmony and compatibility with surrounding uses and with the architectural <br />character and design standards of existing uses and development;. <br />The proposed barn is an existing structure, so it is consistent with the surroundings. <br />7 <br />
