1- Stormwater maragemeni easements shall be provided by the applicant for (1) access for facility inspections <br />and maintenance and (2) preservation of stormwater runoff conveyance, infiltration, and detention areas <br />and facilities, including the overflow route. <br />2. Land used by stormwaier management facilities shall be preserved by dedication andlor perpetual easement <br />to the City, when required by the City. These easements shall cover those portions of the property which <br />are adjacent to the facility and which lie below the 10D-year flood elevation- <br />3. A maintenance agreement shall be recorded with the County as pan of the City development approval <br />process. Minimum requirements for the maintenance agreement include: <br />I. A list of the responsible party(s) {City and facility owner/manager); <br />2. Contact information; <br />3- A formalized maintenance schedule, with scheduled activities; <br />4• A "Failure to Perfonu" provision laying out remedial actions if the responsible party does not <br />perform as expected; <br />5. Maintenance debris handling plans; and <br />6• Emergency response (environmental, spill, safety). <br />4. Maintenance is required for all stormwater practices constructed in compliance with these Policies.
