Sec. 22-33. Definitions. <br />The following words, terms and ph rases,, whenused in this article, shall have the meanings ascribed to them <br />in this section,. except where the contextclearly indicates a different: meaning: <br />Air circulation device means.a mechanis.rh designed. and used for the controlled flow of:air used in <br />ventilation,.cooling or conditioning, iricluding,:but.not limited to; central and window air conditioning. <br />L+Zp means the.sou nd level expressed in.decibels (OBAj..which is exceeded. tern percent of the time for a one- <br />hpur period,. as measured by a sound level meter having characteristics as specified. in the latest standards,.51.4, of <br />the American National Standards Institute and using test procedures approved by.the noise control officer. <br />L+50. means the sound level expressed 1n.&dbels (DBA) which is exceeded 50. percent of the time for a one - <br />hour period;: as measured by a sound level meter having characteristics as specified in the latest standards,.51.4, of <br />the American National 5tandards.Institute and using test.procedures approved by the noise .controI officer. <br />Noise control officer means :the.law.en€orcement agency or person designated by the city council. <br />(Code 1999, § 186:010; Ord, No. 300, 7-19-1583) <br />Sec. 22-34.. Noises. prohibited. <br />No person shall make, orcause to be made, any distinctly and loudly audible noise that unreasonably <br />annoys,:dNturbs, injures or endangers thecomfort, repose, health,peace, safety or welfare of any person or <br />Precludes their enjoyment of property or affects their property value. This general prohibition is not limited by the <br />specific restrictions of the following subdivisions: <br />(1) Motor vehicles. No person shall operate a motor vehicle. in the city in violation of the motor vehicle <br />noise limits of the:state pollution control <br />agency-2} Harris, signaling devices, etc. No. p.erson shall sound any signaling device on any vehicleexcept as a <br />warning of danger. <br />(3) Exhaust discharge. No person shall discharge the exhaust or permit the discharge of the exhaust of any <br />steam engine; -stationery internal combustion engine, motor boat, motor. vehicle or snowmobile except <br />through a muffler or other device that effectively.prevents loud or explosive noises therefrom and <br />complies with all applicable state .laws and regulations. <br />(4) social.gotherings.,No person shall participate In :any party.or:other gatherings of peopl.e.giving rise to. <br />noise.which.disturbs the peace,. quiet or repose of the occupants of adjoining or other property. When: <br />a. police officer determines that a gathering is creating sucli a noise disturbance, the.officer shall order <br />all persons present, other than the owner or tenant of the premises where the disturbance is <br />occurring; to disperse immediately. Every owner or tenant of such. prem ises.shalI cooperate with the <br />police officer and shall make every reasonable effort to abate the disturbance. <br />(5) Loudspeakers, amplifiers for advertising,. etc. No person. shall operate or permit the use oroperation of <br />any loudspeaker, sound ampfifier:or other device for the production or reproduction of sound which is. <br />cast upon the p.ublicstreets. for the purpose of commercial advertising orottracting the attention of <br />the public to..any building or structure, except as may be licenser by tho city. <br />(6) Animals: No person shall keep any animal that disturbs the comfort or repose of persons 1n the vicinity <br />by its frequent or continual noise. <br />(7} schools; churches,. hospitals, etc. No person sha1..1 create any excessive noise on a street, alley or public <br />grounds. adjacent to any school, institution of learning or church or hospita€ when it unreasonably <br />(5upp. No. 5) <br />Page 5 of 13 <br />Created: M.2-.05-05 14:39;56 [EST] <br />
