Sec. 22-84. Entry into or onto the site. <br />While a declaration of public health nuisance for a site is -in effect and has been posted at the.site; no person, <br />other than a law enforcementofficer or a persain authorized by the city, is permitted. to be inside or on a. site.. <br />(Cade 19..99,.§ 18$.12D; Ord'. No, 550, 4-20-zG04) <br />sec. 22-85. Removal of personal property from the site. <br />While a declaration of public health nuisance for a. site is in effect and has been -posted at.the site, no <br />personal property may removed from the site without prior written consent from the city code enforcement <br />officer. Consent to remove personal property maybe granted. at the reasonable discretion of the code <br />enfor-cement.officer; and only incases of hardship.after the following: <br />(1) A city -a pp rovedenvironmental hazard testing and cleaning firm has advised the city, in writing, that <br />the items of personal property can be sufficiently cleaned to rernove.alI harmful contamination; and <br />(2) The owner of the personal property agrees in writing that the owner: <br />a:. Is -aware of the danger of using the contaminated property; <br />b. Will tho rmigh IV. clean the property to remove all contamination. befo re. property is used; and <br />C. Releases:and agrees to indemnify the city fro:rim all liability to the owner and third parties for <br />injuries or damages:a11eg.e.d to have been caused bythe'contaminated property_ <br />(Cade 1999, §:188.130; Ord. Air pollution controls adopted. by reference.. <br />Alrpoilution control rules, regulations and air quality standards of the state pollution control agency are. <br />adoptedby reference into this article 84 fully set forth. <br />(Code 1999; § 146,010) <br />Secs. 22=87-22-112. Reserved. <br />ARTICLE IV. PUBLIC TREES A ND: OTHER VEGETATION <br />Sec. 22-113. Declaration; of. policy. <br />(a) A. variety of trees. within the city limits -are threatened by fatal diseases. The loss of trees growing: upon <br />private and public property woUld substantially depreciate the value. of property within the city and impair <br />the.safety; good.order, general welfare and convenienceof the. public. The.city wishes to control and prevent <br />the spread of tree diseases and has. enacted this article for that purpose.. <br />(bj It is.unlawful for. any person to permit a public tree nuisance that is unsafe to remain on any premises awned <br />or controlled by that person.
