AN ORDINANCE AMENDING ORDINANCE NO. 1.6 OF THE TOWN OF WHITE <br />BEAR, RAMSEY COUNTY, MINNESOTA, BEING AN ORDINANCE DEFINING <br />NUISANCES, PROHIBITING THEIR CREATION OR MAINTENANCE AND <br />PROVIDING FOR ABATEMENT AND PENALTIES FOR VIOLATION THEREOF <br />THE TOWN BOARD OF THE TOWN OF WHITE BEAR HEREBY ORDAINS: <br />SECTION 1. AMENDMENT AND REPEAL OF CONFLICTING ORDINANCES. The <br />Ordinance defining nuisances; prohibiting their creation or maintenance and providing <br />for abatement and penalties for violation thereof passed and approved November 23, <br />1964, as amended, is hereby .amended to read as follows, and all other ordinances or <br />parts. of Ordinances inconsistent herewith are. hereby repealed.. In ali other respects all <br />other Ordinances shall remain in full force and effect. <br />SECTION 2..DECLARATION OF POLICY. The purpose of this chapter is to protect the <br />public health, safety and welfare by enactment of provisions which: <br />271. Define public nuisances and nuisance.condit'ions. <br />272. Determine the responsibilities of owners and operators of dwellings and. <br />property for correction of nuisance conditions: <br />2=3. Provide remedies to eliminate public nuisances. <br />2-4. Provide for administration, enforcement. and penalties. <br />2-5... Promote the stabilization and maintenance of neighborhoods_ <br />SECTION 3. DEFINITIONS. The following definitions shall apply to this chapter: <br />3-1. ATTRACTIVE NUISANCE: A condition such as a: dangerous structure, an <br />unsecured vacant or condemned building, or other condition which in the opinion of the <br />Code Enforcement Officer may attract nonowner(s) or other unauthorized person(s). and. <br />which would expose them to risk, peril. or danger. <br />3-2. DANGEROUS STRUCTURE. A structure which. is potentially hazardous <br />to persons.or property including; but not limited to:. <br />34.1. A structure which is in danger of partial or complete collapse; or <br />3-22. A structure with any exterior parts which are loose or in danger of falling; <br />or <br />3-2.3. A structure with any parts such as .floors, porches, railings, stairs, ramps, <br />balconies or roofs which are accessible and which are. either collapsed, in danger <br />of collapsing, or unable to support the weight of normally imposed loads. <br />3-3: CODE ENFORCEMENT OFFICER. The person or party responsible for <br />enforcement of this Ordinance. or their duly authorized representative. <br />
