refrigerators or trapping devices, which may contribute to injury to the person or <br />property of anyone. <br />SECTION 5. VIOLATIONS. <br />5.1. No person shall, directly or indirectly or by omission, create a nuisance. <br />5-1.1. No owner or responsible party shall allow a nuisance to remain upon or.in <br />any property or structure under his or her control. <br />5-.1.2. No owner of any truck, trailer,. railroad car or flat, or other vehicle shall <br />leave the vehicle standing on or along any street, highway, freeway or railroad <br />track, or other property within the Town, carrying or containing any refuse, <br />noxious substance or hazardous waste, except as otherwise permitted by law or <br />ordinance. <br />5-2. Upon the request of the Code Enforcement Officer; a responsible party or <br />owner shall disclose the name of any other responsible party or owner known to him.. <br />This shall include; but. not be limited to, the person for who he/she is acting, from <br />whom he/she is leasing the property, to whom he/she is leasing the.property, with whom <br />he/she shares joint ownership,. or with whom he/she has any contract pertaining to the <br />real property. <br />SECTION 6. ENFORCEMENT <br />6-1. ORDER TO CEASE. In the event that the Code Enforcement: Officer <br />observes a person creating a nuisance, the Code Enforcement Officer may, after <br />presenting proper identification, order that the person cease and. desist creating a <br />nuisance. <br />6-2. CO©E ENFORCEMENT OFFICER ► UTHORIZED TO ENTER. The Code <br />Enforcement Officer shall be authorized to enter any property or structure in the Town <br />for the purpose of enforcing and assuring compliance with the provisions of this Section.. <br />An owner or responsible party shall, upon the request of the Code Enforcement Officer,. <br />provide access to all interior portions of a building in order 'to permit the Code <br />Enforcement Officer to make.a complete. inspection. <br />SECTION 7. AUTHORITY TO ABATE NUISANCE. <br />7-1. The Town is authorized to abate nuisances in accordance with the <br />procedures set forth in Sections: 9, 10, and 11. All abatement costs incurred by the <br />Town shall be charged against the property as a special assessment to be collected in <br />the manner provided for in Section 12. The Town shall use Hearing Officers to provide <br />landowners with an Initial opportunity to be heard on proposed nuisance abatements. <br />The Hearing Officer shall be..a neutral third party retained ;by the Town to conduct <br />administrative hearings, either for the purposes of nuisance abatement, or in connection <br />With other administrative enforcement programs authorized by the Town Board, <br />7-2. Abatement work may include., but shall not be. limited to, removal, cleaning,. <br />painting of exterior surfaces, extermination, cutting, mowing, grading, sewer repairs, <br />
