10-4.3. The. Town Clerk shall notify the Town Board and cause the notice of <br />public hearing to be published on the Board's agenda. <br />10-5. HEARING OFFICER. Prior to the. Town Board hearing, a Hearing Officer <br />Will be assigned to the matter and shall provide the appellant with an opportunity to. <br />meet and informally discuss the matter. The Hearing Officer may submit to the Town <br />Board a recommendation based on the information .obtained at such a..meeting. <br />1 0-6. HEARING. At the time of the public hearing, the Town Board shall hear <br />from the Code. Enforcement Officer and any other parties who wish to be heard, After <br />the hearing, the Town Board shall adopt a resolution describing what abatement action, <br />if any, the Board deems appropriate.. If the resolution calls. for abatement action, the <br />Board shall fix a time in which the nuisance must be abated, and provide that if <br />corrective action is not taken within the specified time,. the Town shall abate. the <br />nuisance and assess the costs of the abatement. to the subject real estate as a special <br />assessment; <br />10-7. NOTICE OF TOXIN BOARD ACTION. The Town. Clerk shall give a copy of <br />this. resolution to the Code Enforcement. Officer, who shall serve copies to any of the <br />parties required to be noffied in Section 1.0-4. <br />SECTION 11. EMERGENCY ABATEMENT PROCEDURE. When the Code <br />Enforcement Officer determines that an attractive nuisance, a nuisance condition or a <br />dangerous structure exists on a property which. constitutes an immediate danger or <br />hazard which if not immediately abated will endanger the health or safety of the public <br />and there does not exist sufficient time to follow the procedures of Sections 9 and 10, <br />the Town may abate the nuisance by the procedure. described below: <br />11-1. ORDER. The Town shall order emergency abatement by an .adm..inistrative <br />order to be signed by the Town Clerk or their officially designated representative. <br />11-2. NOTICE OF ABATEMENT. Following an emergency. abatement, the Board <br />shall schedule a hearing following notice thereof given in accordance with the <br />requirements set forth in Minnesota Statutes. The notice shall contain: <br />A description of the nuisance; <br />1 1-2.2. <br />The action taken by the Town; <br />11-2.3. <br />The reasons for immediate action; <br />1172.4; <br />The costs incurred. in: abating the nuisance; and <br />11-2.5. <br />The date, time and place of the public hearing. <br />1.4. <br />
