In no case shall a portable storage l disposal container unit be stored on a property <br />more than ninety (90) days in any 12-month period. This provision applies to all <br />residential properties. including single family homes, townhouses, condominiums, and. <br />multi-farni.ly complexes. <br />16-3. Portable storage l disposal container units stored on residential properties <br />in conjunction with a building permit or home improvement project are exempt from <br />these provisions, "except for the. requirement to keep the container unit on an impervious <br />surface: In. such a. case; the property:owner.sha11 make every effort to adhere to the 120 <br />day maximum time limit. <br />1.6-4. Portable storage 1 disposal container units meeting the definition set forth <br />in Section 16-1.1. which are used for regular refuse and recycling pick-up on <br />commercial or industrial properties shall be exempt. <br />SECTION 17. PENALTY. Any person who violates any provision of this chapter, or fails <br />to comply with a lawful order issued pursuant.. to Section 6-1, shall be guilty of a <br />misdemeanor: Each day during which any noncompliance or violation continues snail <br />constitute separate misdemeanor offenses. <br />SECTION 18. OTHER REMEDIES. <br />18-1. The time limits specified in. any order issued under Section 10 is the <br />applicable time period for completion of the rehabilitation and shall supersede: all other <br />time limits. <br />18-2. Nothing in this Ordinance shall be construed :as pertaining to snow removal <br />or to abandoned vehicles. <br />18-3. Nothing in this Ordinance shall preclude the Town from prosecuting any <br />alleged violations of related Minnesota Statutes, including Minnesota Statutes, § 609.74 <br />and § 6.09.745. <br />SECTION 19. SEVERABILITY. Should any section., subdivision, clause or other <br />provisions of this Ordinance be held to be invalid by any court of competent jurisdiction., <br />such decision small not affect the validity of the Ordinance as a whole, or of any part <br />thereof, other than the part held to be. invalid. <br />SECTION 20. EFFECTIVEDATE. ATE. This Ordinance shall take effect and be in force from <br />and after its passage and publication. <br />23 <br />
