i- Stormwater management easements shall be provided by the applicant for (1) access for Facility inspections <br />and maintenance and (2) preservation of stormwaler runoff conveyance, infiltration, and detention areas <br />and facilities, including the overflow route. <br />2. Land used by stormwater management facilities shall be preserved by dedication and/or perpetual easement <br />to the City, when required by the City. These easements shall cover those portions of the property which <br />are adjacent to the facility and which lie below the 100-year flood elevation- <br />3. A maintenance agreement shall he recorded with the Cc" as pan of the City development approval <br />process. Minimum requirements for the maintenance agreement include: <br />l- A list of the responsible party(s) (City and facility ownerlmanager); <br />2. Contact information-, <br />3- A formalized maintenance schedule, with scheduled activities: <br />4. A "Failure to Perform" provision laying oul remedial actions if the responsible party does not <br />perform as expected; <br />S.
