SECTION 15. INSTITUTIONAL OVERLAY DISTRICT <br />1. Purpose. <br />1. The Institutional Overlay District is intended to provide a means of overlaying an existing Zoning district located <br />in the City of Gem Lake, for facilities devoted to serving the public. This district is unique in that the primary <br />objective of uses within this district is for the providing of services, frequently on a non-profit basis, rather than for <br />the sale of goods or services. It is intended that all uses within such an overlay area will be compatible with all <br />adjoining uses. <br />2. The Institutional Overlay District shall be applied to and superimposed as an overlay upon any zoning district, <br />defined in this Zoning Ordinance, as existing or amended by this section and as shown on the official Zoning Map. <br />The Institutional Overlay District will remain in effect as long as the use and the user remains the same. If an <br />overlay area is no longer used, uses are changed or terminated, the parcel will revert back to its original underlying <br />zoning classification. <br />2. Permitted Uses. Subject to applicable provisions of this Ordinance, the following are permitted uses in an Institutional <br />Overlay District: <br />1. Religious institutions such as churches, chapels, temples and synagogues, but with activities limited to worship and <br />related social activities. <br />2. Private Child Care and Education facilities as defined in the definitions section of this Ordinance, but with <br />activities limited to school/educational activities. <br />1. An enrollment with an age not to exceed twelve (12) years; <br />2. A total enrollment of not less than twenty-five (25) nor more than one -hundred eighty two (182); <br />3. A maximum of one -hundred eighty two (182) "full -day equivalent" students with a full -day* defined as <br />ten (10) hours. <br />4. The full -day equivalent" shall be calculated by adding together the total number of students present during <br />each hour of the "full -day" of school. This total shall not exceed 1,820, which is 182 students' times 10 <br />hours. <br />3. Permitted Accessory Uses. Subject to applicable provisions of this Ordinance, the following are permitted accessory uses <br />in any Institutional Overlay District: <br />1. Accessory uses, customarily incidental to the uses permitted as a Permitted Use or Conditional or Interim Use (if a <br />Conditional or Interim Use is allowed). <br />2. Off-street parking and loading areas. <br />3. Accessory building as described in Appendix A of this Ordinance. <br />4. Conditional or Interim Uses. Subject to applicable provisions of this Ordinance, the following are considered to be <br />Conditional Uses in the Institutional Overlay District. <br />1. Living quarters (such as parsonage, rectory or care -takers house) that are supplied as an accessory use to a principal <br />use provided that: <br />1. The use shall not be used as a rental property; <br />2. The maximum of one (1) such dwelling shall be allowed; <br />3. There shall be a demonstrated and documented need for such a facility. <br />2.
