Setback measured from the closest of any lot line, road, road easement, road right-of-way or the like. <br />6. Lot Coverage and Height Requirements. The following lot coverage and height requirements shall be observed in the <br />Institutional Overlay district: <br />1. The total lot coverage of all buildings and other structures shall not exceed thirty (30%) percent <br />2. The minimum open space requirement for any proposed use shall be twenty (20%) percent, including green areas <br />not covered by buildings, parking lots, access roads, storage areas or other areas covered by impervious surfaces. <br />3. No building structure shall exceed thirty-five (35') feet in height. <br />4. No accessory structure shall exceed two (2) stories or twenty-five (25') feet in height, whatever is lesser and no <br />accessory structure any part of which is within three -hundred (300') feet of an "R" district or a roadway bordering <br />an "R" district shall exceed fifteen (15') feet in height. <br />7. Landscaping and Screening. <br />1. As most Institutional Overlays will occur in residential areas or closely adjacent to Residential areas, landscaping <br />and screening shall be provided to isolate all light and noise from the Institutional Overlay use from entering the <br />adjacent Residential areas. This landscaping and screening must be done in accordance with the procedures in this <br />Ordinance. <br />8. Procedures for Requesting an Overlay. <br />1. Application for re -zoning for an overlay. <br />1. An Institutional Overlay shall be considered a rezoning for a specific parcel of land. This overlay may <br />occur in any zoning district in the City of Gem Lake. The application for an Institutional Overlay shall be <br />made on a form provided by the City Clerk. The fee for an Institutional Overlay shall be the same as the <br />rezoning fee, defined in the Zoning Ordinance. This application for rezoning will only be deemed to be <br />complete when the following are received: <br />1. A properly completed application and payment in full is received; <br />2. A registered property surveyors report is provided properly identifying the parcel to be rezoned; <br />3. All requirements of the Plan Review described in Appendix A of this Ordinance have been met. <br />These plans must be reviewed and approved by the Zoning Administrator, Planning Commission <br />and City Council before any overlay shall be granted. If this is a rezoning to initially define and <br />overlay, the rezoning activities and the Plan Review shall occur at the same time; <br />4. Proof of ownership or authorization shall be provided. The applicant shall supply proof of title <br />and the legal description of the property for which the Institutional Overlay is requested <br />consisting of and abstract of the title or registered property abstract currently certified together <br />Updated January 2025 — Gem Lake Consolidated Land Use Ordinance No. 131 67 <br />
