Statement on former Zoning Ordinance Number 43 revision K <br />THE ZONING ORDINANCE OF GEM LAKE, MINNESOTA, RELATING TO AND REGULATING THE LOCATION, SIZE, <br />USE AND HEIGHTS OF BUILDINGS, THE ARRANGEMENT OF BUILDINGS ON LOTS, AND THE DENSITY OF <br />POPULATION IN THE CITY OF GEM LAKE, AND FOR THE PURPOSE OF PROMOTING THE PUBLIC HEALTH, SAFETY, <br />ORDER, CONVENIENCE, PROSPERITY AND GENERAL WELFARE IN SAID CITY, AND FOR SAID PURPOSE, TO <br />DIVIDE THE CITY INTO DISTRICTS, AND MAKE DIFFERENT REGULATIONS FOR DIFFERENT DISTRICTS. <br />The City of Gem Lake does ordain as follows: <br />SECTION 1. TITLE. <br />This Ordinance shall be known, cited and referred to as ORDINANCE NO. 131 CONSOLIDATED LAND USE ORDINANCE <br />except as referred to herein, where it shall be known as "this Ordinance". <br />SECTION 2. INTENT AND PURPOSE. <br />Intent. The intent of this consolidated land use ordinance is to provide a single source for all real property subjected to <br />development within the City of Gem Lake. It combines zoning (including the Gateway District), subdivisions, signs, <br />landscaping, and tree preservation, into one single ordinance and combines the definitions into one appendix. This <br />Consolidated Land Use Ordinance is to be used in conjunction with Gem Lake's Comprehensive Municipal Plan to guide <br />development and redevelopment and will serve as the basis from which the merits of proposed development and <br />redevelopment projects will be evaluated. While this consolidated land use ordinance has combined several formerly stand- <br />alone ordinances, it has not changed the scope and intent of those ordinances. Instead, the consolidated land use ordinance <br />simply gathers these several ordinances and places them inside a single ordinance. <br />2. Purpose. This Ordinance is adopted for the purpose of: <br />1. Protecting the public health, safety, morals, comfort, convenience and general welfare; <br />2. Dividing the City into zones and districts restricting and regulating therein the location, construction, <br />reconstruction, alteration, and use of structures and land; <br />3. Promoting orderly development of the residential, business and industrial areas; <br />4. Providing adequate light, air, and convenience of access to property; <br />5. Preventing overcrowding of land and undue concentration of structures by regulating the use of land and building <br />and the bulk of building in relation to the land and building surrounding them; <br />6. Providing for the compatibility of different land uses and the most appropriate use of land throughout the City; <br />7. Supporting the ideals of and providing for local controls consistent with the Gem Lake Comprehensive Municipal <br />Plan as adopted and, from time to time, amended. <br />SECTION 3. RULES AND DEFINITIONS. <br />1. Rules. The language set forth in the text of this Ordinance shall be interpreted in accordance with the following rules of <br />construction: <br />1. The singular number includes the plural and the plural singular; <br />2. The present tense includes the past and future tenses, and the future present; <br />3. The word "shall" is mandatory, and the word "may" is permissive; <br />4. The masculine gender includes the feminine and neuter genders; <br />5. Where words or phrases are not defined within the definitions of this Ordinance, they hall have their ordinary <br />accepted meanings within the context in which they are used; <br />6.
