SECTION 16. GENERAL PROVISIONS <br />1. Application of this Ordinance. <br />1. In their interpretation and application, the provisions of this Ordinance shall be held to be the minimum <br />requirements for the promotion of the public health, safety, morals and welfare. <br />2. Where the conditions imposed by any provision of this Ordinance are either more restrictive or less restrictive than <br />comparable conditions imposed by any other law, ordinance, statute, resolution, or regulation of any kind, the <br />regulations which are more restrictive, or which impose higher standards or requirements shall prevail. <br />3. Except as in this Ordinance specifically provided, no structure shall be erected, converted, enlarged, reconstructed <br />or altered, and no structure or land shall be used, for any purpose, nor in any manner which is not conformity with <br />this Ordinance. <br />4. When land is proposed to be annexed to the City of Gem Lake the Planning Commission shall hold a public <br />hearing upon the permanent zoning of said land. The results of the hearing, along with a recommendation, shall be <br />presented to the City Council. In the event of annexation proceedings becoming final before the permanent zoning <br />is determined, the annexed area shall be placed in the "RE" District and such classification shall be considered as <br />an interim step pending permanent classification. <br />5. Real Property Development. making application for development of real property in the City of Gem Lake, the <br />developer shall submit twelve (12) sets of all plans, variance requirements, and permit requirements in forms <br />acceptable to the Zoning Administrator or City officials including, but not limited to, the following: <br />1. A Site Plan; and <br />2. A Grading and Filing Plan; and <br />3. A Landscape Plan; and <br />4. A Tree Preservation Plan; and <br />5. A Sediment and Erosion Control Plan; and <br />6. A Storm Water Management Plan; and <br />7. A Description of the Project; and <br />8. A Description of Future Expansion Plans; and <br />9. All Variances, Conditional and Interim Use Permits, and Zoning Amendments required; and <br />10. All other such plans or information as may be required for specific zoning districts. <br />6. Development Review Considerations. When making recommendations and decisions considering land use, <br />variance applications, or rezoning applications, the Planning Commission and City Council shall review and <br />measure the impact of such uses including, but not limited to, the following as criteria: <br />1. The impact of the use on adjacent uses; and <br />2. The impact of the use on air and water quality; and <br />3. The impact of the use on traffic generation; and <br />4. The impact of the use on public safety, health and welfare; and <br />5. The impact of the use on the economy. <br />Updated January 2025 — Gem Lake Consolidated Land Use Ordinance No. 131 71 <br />
