3. In all Business Districts, a building permit shall not be issued unless the proposed use is designed, sited, oriented <br />and landscape -planned to produce a harmonious relationship of building and grounds with adjacent buildings and <br />grounds and with the environment of the neighborhood. <br />4. In all Residential Districts, a building permit shall not be issued if the proposed building is so similar or dissimilar <br />to the other homes in the area as to result in depreciation of property values in the neighborhood. <br />14. Explosives. <br />1. No activities involving the storage, utilization or manufacture of materials or products, such as TNT or dynamite, <br />which could decompose by detonation shall be permitted except such as are licensed by the Council. <br />15. Radiation and Electrical Emissions. <br />1. No activities shall be permitted that emit dangerous radio -activity beyond enclosed areas. There shall be no <br />electrical disturbance (except from domestic household appliances) adversely affecting the operation at any point <br />of any equipment other than that of the creator of such disturbance. <br />16. Aircraft. <br />1. Landing Area. Aircraft landing areas are hereby prohibited within the City of Gem Lake. <br />2. Operation. The landing and the taking off of aircraft within the City of Gem Lake is prohibited except for <br />emergencies or by duly authorized law enforcement, military or medical transport aircraft. <br />17. Other Nuisance Characteristics. <br />1. No noise, odors, vibration, smoke, air pollution, dangerous wastes, heat, glare, dust, or other such adverse <br />influences shall be permitted in any district that will in any way have an objectionable effect upon adjacent or <br />nearby property. <br />2. All wastes shall be properly contained, fenced or screened and disposed of in a manner that is not dangerous to <br />public health and safety. <br />18. Consistency with Plans and Policies. <br />1. The proposed use shall preserve the intent and purpose of this Ordinance and shall be consistent with the goals, <br />plans and policies of the City's Comprehensive Plan. <br />19. Clustering and Density Transfer. <br />1. This clustering and density transfer system is to provide a means by which parcels of land in the City of Gem Lake, <br />having unusual building characteristics due to subsoil conditions, elevation of the water table, water area, and/or <br />relative location or shape of the parcel may be more efficiently utilized. Density zoning also provides a means to <br />preserve and protect natural resource areas such as wetlands, woodlands, steep slopes, as well as good agricultural <br />land and scenic views. Basically, this approach allows a developer to cluster housing or business units in buildable <br />areas in return for leaving the natural resource areas or agricultural land open from development. <br />2. The City Council, in determining the reasonableness of the proposed clustering, shall consider the following <br />factors: <br />1. Location, amount and proposed use of open space; <br />2. Location, design and type of dwellings or business provided; <br />3. Physical characteristics of the site; <br />4. Relationship of the proposed dwelling or business units to nearby uses. <br />3. The owner or owners of any tract of land in the City of Gem Lake may submit to the Planning Commission, for <br />review and recommendation to the City Council, a plan for use and development of such a tract of land as a cluster <br />area by making an application for a Conditional Use Permit authorizing completion of the project according to an <br />Updated January 2025 — Gem Lake Consolidated Land Use Ordinance No. 131 93 <br />
