Messing CLIP Staff Report <br />Gem Lake Planning Commission Page <br />March 8, 2022 <br />The proposed.. structure size being over 1,000.3F Triggers the need fora CUP from the city. The site as a <br />whole currently has an attached garage, and a detached shed, together totaling 728 SF. The. proposed <br />new detached accessory structure would have a. footprint of 2,176 SF, as well as. a 680 SF covered porch <br />on the.: south side. <br />Other zoning requirements would be required to be met. The proposed structure would have ample space <br />to meet the applicable setback requirements required. The applicant proposes to be 1.5 feet from the <br />north side property line, and nearly 100 feet from the rearleast property line. The structure would be over <br />70 feet from the south side property line, and over 300 feet from the front property line. <br />The maximum height permitted for an accessory structure is.25 feet; the proposed structure would be. at <br />the maximum permitted. The RO zoning district requires a minimum of 40% of the. lot to be open space, <br />which would equate to 60% of the lot occupied by impervious surfaces. The property, being 1.3 acres in <br />size, would have approximately 10%: of the lot occupied by impervious surfaces (huildings, driveways,. <br />etc.) if this request is approved. The extension of utilities would have to follow .city requirements, and the <br />construction would have to follow applicable building code requirements as well. <br />In discussions with city staff, there have been a few recent requests for :exceeding the 1,000 SF threshold. <br />for accessory structures. The recent CUP request for 3825 Sche.uneman Road permitted a 1,440 SF <br />detached accessory structure:on the property. There was also a CUP issued in 2021 for a detached <br />accessory structure on 5 Hillary Lane, which brought the. total number of accessorystructures on the site <br />to more than two and the total size of the. accessory structures to a total of 1,284 SF. A CUP was issued <br />for 1430 Goose Lake. Road in 2018, .to add a second garage on that property. The .second .garage was <br />only 576 SF in size, though combined with the other accessory structures on the site the total square <br />footage was above. 1,000 SF for the site: The property directly to the north of our applicant, 400.0 <br />Scheuneman Road, has a detached accessory structure of approximately 1,500 .SF in size. Other <br />properties near our applicant's lot (401:0, 4015, 4020 Scheuneman) also have large detached accessory <br />structures currently on their sites. <br />Conditional Use Permit Criteria <br />When reviewing a .CUP request, impact on.the following.criteria shall -be reviewed by the..city, as noted in <br />Section 17.5.2(A); <br />1). Adjacent Uses <br />2) Air and Water Quality <br />3) Traffic Generations <br />4) Public Safety and Health <br />5) Area Aesthetics. <br />6] Economic Impact on the Entire Area <br />7] Consistency with the Comprehensive Municipal Plan <br />8) Anticipated Duration of the Conditional or Interim Use <br />Section 17.5.9(B) of the further notes that the following: standards. apply to new CLIPS. <br />1.) Compliance with all zoning and. other regulations:as may otherwise be applicable; <br />2) The date or the eventthat will terminate the use. can be identified with certainty, <br />3) The existence of the Conditional or Interim Use will: not impose additional costs. on the public. if it <br />becomes necessary for the public to take the property in the future; <br />
