Conditional Use Permit Request for 3610 Highway 61 North <br />Gem Lake Planning Commission 12/2/2025 <br />November 24, 2025 <br />Page 6 <br /> <br /> <br /> <br /> <br />Ordinance Criteria <br /> <br />Ordinance No. 131, Consolidated Land Use Ordinance, regulates Conditional Use Permits in Section 17.5. When <br />reviewing a Conditional Use Permit application, the following criteria shall be reviewed and measured by the <br />Planning Commission and City Council (17.5.2.1): <br /> <br />1. Adjacent Uses <br />2. Air and Water Quality <br />3. Traffic Generations <br />4. Public Safety and Health <br />5. Area Aesthetics <br />6. Economic Impact on the Entire Area <br />7. Consistency with the Comprehensive Municipal Plan <br />8. Anticipated Duration of the Conditional or Interim Use <br /> <br />This is an application related to illumination. The Commission’s recommendation should not take signage size, <br />design, or location into account but the purposed signage meets the applicable development standards of Section <br />19, which has no additional language for internal illumination and references the criteria in Section 17.5. The <br />criteria are listed below in italics, followed by a staff evaluation that focuses on the effect of the "7100K LED <br />lamps" in the sign. <br /> <br />1. Adjacent Uses <br />This criterion is met. Adjacent to this property is a State Highway and County Road with additional business <br />including a car dealership, other commercial uses including a bank, retail sales and services, restaurant, a <br />wooded area and limited residential multifamily buildings across the street from the property . The proposed <br />illumination does not appear to impact adjacent uses. <br /> <br />2. Air and Water Quality <br />This criterion is met. Illuminated signage would not be expected to impact air and water quality. <br /> <br />3. Traffic Generations <br />This criterion is met. The proposed signage does not generate additional traffic but instead enhances safety and <br />circulation by clearly identifying entrances, exits, and service areas. Improved visibility and wayfinding reduce <br />confusion for motorists and pedestrians accessing the dealership. <br /> <br />4. Public Safety and Health <br />This criterion is met. Illuminated signage would not be expected to impact public safety and health. <br /> <br />5. Area Aesthetics <br />This criterion is met. Illuminated signage could impact the area aesthetic positively, as the proposed signage <br />would establish a high-quality aesthetic that compliments the existing corridor and building architecture . The view <br />from adjacent properties would not be greatly impacted due to the uses in the area. <br /> <br />6. Economic Impact on the Entire Area <br />This criterion is met. Illuminated signage would not be expected to have an economic impact on the entire area. <br /> <br />7. Consistency with the Comprehensive Municipal Plan <br />This criterion is met. Illuminated signage is not explicitly mentioned in the 2040 Comprehensive Plan. LED <br />illumination does not contradict any Comprehensive Plan goals. <br /> <br />8. Anticipated Duration of the Conditional or Interim Use <br />This criterion is met. There would be no anticipated dissolution of the conditional use. Conditional uses, if <br />discontinued for 6 months, are considered void.
