Ordinance 45 – Garbage & Refuse <br />Gem Lake Planning Commission <br />March 12, 2024 <br />Page 2 <br /> <br /> <br /> <br />ITEMS TO CONSIDER FURTHER <br /> <br />Section 2.4.2 – Definitions <br />• (ii) Commissioners should consider the definition of Apiary Products and how it relates to Home <br />Occupations. Ordinance No. 134, regarding Home Occupations, currently requires a resident have a <br />home occupation permit for any sale requiring customers to come to the property. <br />o What products and materials would the commissioners consider acceptable to be sold via a home <br />occupation? <br />o What materials should not be included in this definition? <br />• (x) Review the definition of Undeveloped Property. <br />o What thoughts do the commissioners have, for example, on permitting or prohibiting temporary <br />sales of apiary products raised on an undeveloped property in the Gateway Zone? <br />Section 4.1.3 - Standards of Practice <br />• (v) Review the proposed standard for allowing nucleus colonies and refer to the definition 2.4.2 (ix) <br />o Does the commission understand the practice of keeping nucleus colonies in tandem with the <br />main colonies? <br />Section 4.2.4 – Right of Entry for Inspections. <br />• Ordinance 142 currently states, in Section 4.2.1 that “…this Ordinance shall be enforced by the Animal <br />Control Officer and other such persons or agency as may, from time to time, be appointed by the City <br />Council” in the Enforcement, Record, and Penalties section. <br /> <br /> <br />NEXT STEPS <br />The Planning Commission should review draft Ordinance No. 142. Any further changes should be recommended <br />to staff. If there are no edits, a recommendation may be made to the City Council for their review. <br /> <br />Attachments: <br />1.
