<br />CITY OF GEM LAKE, RAMSEY COUNTY, MINNESOTA
<br />AN ORDINANCE REGULATING THE DISPOSAL OF GARBAGE, RUBBISH, AND OTHER
<br />REFUSE, AND
<br />PROVIDING PENALTIES FOR VIOLATION THEREOF
<br />THE CITY COUNCIL OF THE CITY OF GEM LAKE ORDAINS:
<br />Section 1. Purpose. It is the purpose of this ordinance to regulate the disposal of garbage, rubbish, and
<br />other refuse in the City of Gem Lake so as to control rats and other vermin and otherwise protect the
<br />health of the inhabitants and property located in the City.
<br />Section 2. Definitions. For the purpose of this ordinance, the following terms, phrases, words, and their
<br />derivations shall have the meaning given herein. When not inconsistent with the context, words used in
<br />the present tense include the future, words in the plural number include the singular number, and words in
<br />the singular number include the plural number. The word "shall" is always mandatory and not merely
<br />directory.
<br />2(A). Commercial Establishment - . shall mean any Any premises where a commercial or
<br />industrial enterprise of any kind is carried on, . and shall includeThis would include but is not limited to:
<br />hotels and boarding houses, clubs, churches, and establishments of nonprofit organizations where food is
<br />prepared or served or goods are sold.
<br />2(B). Garbage. shall mean - animal Animal and vegetable wastes resulting from the handling,
<br />preparation, cooking, service and consumption of food, and shall also include all other animal wastes, but
<br />shall not include refuse or hazardous waste..
<br />2(C). Hazardous Waste shall mean- hHazardous waste as defined in Minnesota Statutes,
<br />Section 116.06, subdivision 13.
<br />2(D). Incinerator. shall mean - aAny device sued used for the destruction of refuse, rubbish, or
<br />waste materials by fire.
<br />2(E). Multiple Dwelling Residence - A property containing more than four (4) dwellings, with
<br />individual kitchen facilities for each.
<br />2(F). Open burningBurning. Means - tThe burning of any matter whereby the resultant
<br />combustion products are emitted directly to the atmosphere without passing through an adequate stack,
<br />duct, or chimney.
<br />2(G). Refuse. shall include - aAll wastes which normally result from the operation of a
<br />household, (except body wastes), including but not limited to: Garbage,except body wastes and garbage,
<br />including, but not limited to, rubbish, tin cans, paper, cardboard, glass jars, bottles, wood, grass clippings,
<br />Christmas trees, ashes, sod, dirt, tires, rocks, household construction material, cement bricks, trees,
<br />leaves, hedge or tree trimmings, burning barrels and mesh backyard burners, household appliances and
<br />furniture, or any other household refuse or materials small enough for one man to handle. The term
<br />"refuse"This term shall not include hazardous waste, construction material or other waste or debris
