Gem Lake – Solicitors Ordinance Updates <br />Gem Lake Planning Commission Meeting 11/12/24 <br />November 5, 2024 <br />Page 3 <br /> <br /> <br /> <br />ORDINANCE UPDATES <br /> <br />The following updates have been proposed to align with the LMC’s model ordinance, and to follow the City’s <br />typical Ordinance formatting. <br /> <br /> <br /> <br />Section Action Content <br />Section 2. <br />Definitions <br />Remove Canvasser (incorporated into the definition of “Solicitor”) <br />Add “For the purpose of this ordinance, the term door-to-door advocate shall <br />fall under the term solicitor and include door-to-door canvassing and <br />pamphleteering intended for non-commercial purposes” <br /> <br />to the Non-Commercial Door-to-Door Advocate definition <br />Remove “Engaged in for profit business with no fixed place of business…” <br /> <br />from the definition of Peddler. <br />Remove Professional Fundraiser is not included in the LMC model ordinance. <br />Review this definition and Section 8.3; could remove. <br />Update The definition of Solicitor to “A person who goes from house-to-house, <br />door-to-door, business-to-business, street-to-street, or any other type of <br />place-to-place movement, for the purpose of obtaining or attempting to <br />obtain orders for goods, wares, products, merchandise, other personal <br />property, or services of which he or she may be carrying or transporting <br />samples, or that may be described in a catalog or by other means, and <br />for which delivery or performance shall occur at a later time. The absence <br />of samples or catalogs shall not remove a person from the scope of this <br />provision if the actual purpose of the person’s activity is to obtain or <br />attempt to obtain orders as discussed above. For purposes of this <br />ordinance, the term solicitor shall have the same meaning as the term <br />canvasser” <br />Update The definition of Transient Merchant to “A person who temporarily sets up <br />business out of a vehicle, trailer, boxcar, tent, other portable shelter, or <br />empty store front for the purpose of exposing or displaying for sale, <br />selling or attempting to sell, and delivering goods, wares, products, <br />merchandise, or other personal property and who does not remain in any <br />one location for more than fourteen (14) consecutive days” <br />Section 8. <br />Registration <br />Remove 8.3 is a variation from the model ordinance. Consider keeping or <br />removing “Professional fundraisers not exempt. A professional <br />fundraiser working on behalf of an otherwise exempt group or person <br />shall not be exempt from the licensing requirements of this ordinance.” <br />Section 13. <br />Enactment <br />Update Formatting to match that of recent City Ordinances. <br />History of the <br />Ordinance <br />Add A table describing the history of the ordinance.
