MEMORANDUM <br />TO: GEM LAKE <br />FROM: TOM RIEDESEL <br />DATE: APRIL 19, 2021 <br />SUBJECT: FENCING — VARIANCE AND CONDITIONAL USE PERMIT FEES <br />Staff was asked to research the process to allow a fence to exceed 6' in height, This is <br />related to a request from a homeowner on Scheuneman Road where the Homeowner <br />would like. to construct an 8' high fence. to surround his garden. A 6' high fence is the <br />maximum height allowed except by Conditional Use. Permit. Section 16.14,Mgj of the <br />Consolidated Land Use Ordinance states a. Conditional Use Permit is required to exceed <br />6' in height. Section 16.14.1(h) requires fencing not to exceed 6', but must be setback a <br />minimum of 95' from a property line and must be 80% open. Section 16.14.1(h) regulates <br />fence height when used to protect gardens, crops and shrubs from. deer or other wildlife. <br />The 8' high fence is being requested to keep deer out of a garden. <br />Per Section 1.6,14,1(g) — a Conditional Use: permit must be approved by the City to allow <br />an 8' high fence. <br />The. City website requires an application and a fee of $75.00 (plus $200 escrow deposit) <br />to review a .C.onditional Use Permit. <br />Review of the fence'permit initially appeared that a fence height variance may be required. <br />The application far a variance is $5.06 plus a. $1,000 escrow.. <br />Staff was asked to review variance and Conditional Use Permit fees for nearby <br />communities. The following was found:. <br />CUP <br />Vadnais Heights <br />Single Family Homes $500 plus $1000 escrow <br />Commercial $1000. plus $1600 escrow <br />White Bear Lake <br />All $400 <br />Variance <br />$350 plus $1500 escrow <br />$700 plus $1500 escrow <br />Residential $250 <br />Commercial $50.0 <br />
