Clerk <br />Gem Luke, MN 551.19-523.1 <br />FACSIMILE: (612) 426-6444 <br />Richard :Nordstrom, Treasurer <br />Mr, Vince Johnson <br />7716 Major Avenue North <br />Brooklyn Park; MN 55443 <br />RE: Filling Qf Land At 3524 Hoffman Road <br />Permit File 4SUSE9404,11OC <br />Dear Mr, Johnson, <br />21 June 1994 <br />Pursuant to action taken by the Gem Lake City Council at it's regular meeting on 20 June. 1994 relative to your <br />Application For Consideration Of Zoning Request to allow deposit of an unspecified quantity of clean ./711, be advised as <br />follows: <br />CONSIDERATIONS <br />1) Filling commenced as early as September, 1993 without issuance of appropriate permits.from the City of Gem Lake <br />thus violating: Sections 4,10(1), 5.6(1-3)., and 5.8(1-2) of Gem Lake Zoning Ordinance No. 43.. <br />2) Fill used was extracted font areas unknown without issuance of any statement of their origin and content including, <br />but not limited to, potential unknown contaminants which may represent a danger to long-term public health. <br />3) Theamount of said unspecified fill has not been stated. <br />ACTION REQUIRED <br />4) All filling .ofyour :properly and site work related thereto as identified on your above referenced application <br />shall cease iniinediately. <br />5j Correspondence from the legal jurisdictions) (eg city, town, etc) from which the materials used for filling <br />were taken stating contents of the materialsand listing any and all potential contaminants to the .satisfaction of the <br />Gem Lake Planning Commission and City Council <br />6} Correspondence fi•am the contractor who removed the materials used for filling frontthe point(s) of origin <br />statingthe origins) of the materials; namingthe carriers) whoremoved said materials fromthe point(s) of origin, <br />stating then only materialsidentified in 5) above weredelivered by the .carrter(s), andstating the quantity of <br />materials removed from each of :the point(s) of origin. <br />7) Correspondence from the carrier stating the date of first delivery to your site and the total quantity of <br />materials delivered to your site from each of the point(s) of origin of .said materials. <br />By means: of action taken by the City Council, you are hereby required to comply with items 4) through 7) above. <br />Item 4) is effective.. immediately. Items 5) through 7) are to be delivered to the Zoning Administrator or the chairman of the <br />Gem Lake Planning Commission as soon as possible Upon receipt, the Planning Commission will review said representations <br />and,if found to be satisfactory, will followthe course of action as described to ordinance No, 43 for issuance of a Special <br />Use Permit. As significant quantities of fill have alreadybeen delivered to the site, the Planning Commission and/or the City <br />Council may at their sole discretion in consideration of public health and safely and as a .condition of approval,require <br />additional verification offal content such as soil boring and analysis by an accredited testing: laboratoryor other similar action. <br />1 <br />
