In the edit of such termination, thee terminating party shall give the <br />other party -as much notice: -of such cancellation as is reasonably possible <br />W. with the law, regulation or judicial decision. <br />2) Either party fails to'eomply with an award pursuant to paragraph A) above. <br />3) Either party may terminate with or without cause provided the terminating <br />party provides the non -terminating party with 90 days' written. notice.. <br />SECTION III <br />Financial Obligation of City of Gem Lake <br />The City shall pay the Township according to the parties:' agreement of $9$:00per <br />M hour;. plus related. equipment charges, dependent: on the Emergency, paid to the Township <br />upon invoice;. The Township's fees will be- reviewed by the parties annually. <br />SECTION IV <br />Procedure to Reauest Emergency Response <br />In the everts- of an emergency request during business hours; the City shall. contact the <br />Township's Public Works Director or designee. After business:hours,.-the eontact-shall be <br />'White Bear Township's On -Call Person. The Public Works Director, designee.or 0 <br />Call Person. shall. notify the City's Mayor or designated individual as to the xespaase and <br />resolution of the emergency. <br />SECTION V <br />Best Efforts. <br />The Township shall respond to the emergency request by the City rising best practices <br />and equipment that are ayailable at the time.of the request. There may bean incident <br />where the Township cannot properly respond to the emergencyâ–º request.
