June 14,.2021 <br />Planning Commission Recommendations Related to Truck Farming! Commercial <br />Gardening in Residential Districts: <br />First recommend the response to Daniel Me sembour 's al2l2lication be a <br />CUP with conditions very specific to his lot and his specific organic garden <br />operational plan. We agreed his lot situation was unique (street configuration, <br />location, railroad, etc.), the current ordinance guidance is not perfectly clear, and his <br />.neighbors were in favor of his plan. <br />Thy, (quickly, in the next few weeks at the direction of the City Council. to the <br />Planning Commission) fix the language In Land. Use Ordinance No. 131 to <br />eliminate confusion by .making all forms of truck farming/commercial gardening a <br />Conditional Use rather than Permitted Use.. That would help provide. <br />(.Council/Patrick Kelly will probably direct us to do this at our next meeting with <br />another public hearing.) <br />Sample language to be considered for proposed changes to the City of Gem Lake. MN <br />Land Use Ordinance No.131: <br />Move From Section 5.1 Permitted Uses: <br />"5.1.2 Truck gardening and other horticultural uses provided that only those <br />products. produced on the premise be sold or offered fors ale. <br />To Section 5.3 Conditional & Interim Uses: <br />"5.3.8 Truck gardening and other commercial horticultural uses provided that only <br />those. products produced on the premises be sold or offered for.sale," <br />This gives the city better control over truck gardening and. other commercial horticultural uses. <br />Also, by eliminating truck gardening and other commercial horticultural uses as permitted uses <br />in any Residential Zone, the Garden Overlay District can be invoked (as currently intended) on <br />lots over 10 acres or conditions can be established for similar uses. on smaller lots.. <br />The discussion at the Planning Commission meeting indicated at least some concern about <br />unintended consequences if truck farming/commercial gardening were to be allowed on other <br />city lots Less than an acre. I the City Council wishes to limit truck gardening and other <br />commercial horticultural uses to lots with enough size that garden fence setbacks can be <br />reasonably met or that CUP conditions could adequately mitigate the impact on neighbors, then: <br />Change in Section 7.3 Conditional & Interim Uses: <br />7.3.1 C) The.harboring and housing of agricultural animals .on lots greater:than <br />one (1.0) acre." <br />To: <br />7.3.1.
