Federal Transit Administration (FTA) is writing to continue consultation for the Rush Line Bus Rapid <br />Transit.(BRT) Project (Project), Please find enclosed for your signature the Memorandum n Agreement <br />(MOA) for the Project. <br />This MOA is the outcome of an extensive consultation effort among multiple. Federal agencies, the <br />Minnesota State Historic Preservation Office; the Metropolitan Council, .other interested parties, and the <br />public. Prepared in accordance with the provisions of 36 CFR Part 800, the MOA documents and guides <br />es. <br />measures: determined to resolve the Project's anticipated adverse effects to historic propertiThe..MOA <br />includes measures to avoid, minimize, and mitigate adverse effects; processes for updating the Area of <br />Potential Effects (APE), conducting additional. survey and evaluation of historic. properties, and assessing <br />1'rojecteffects on historic properties; guidance for handling unexpected discoveries or unanticipated effects <br />during project construction; and procedures for reporting on agreementimplementation, dispute resolution, <br />and .amending or terminating the agreement. <br />Since all consulting parties last reviewed the document in May 2021, :public comments have been sought <br />and received through the public comment period on the Project's Environmental..Assessment. In addition, <br />FTA reopened consultation with American Indian tribes .and a tribal consultation meeting: was held on <br />Monday, August 23, 2021. Based on these activities, FTA has made minor modifications to the document <br />,in consultation with tl�e Signatories and Invited Signatories. The modifications address. consulting party <br />and public comments "received on the May 2021 draft, incorporate edits received from legal review of the <br />document, and allow for additional identification and assessment of effects baseduponreceipt of additional <br />information about properties its the APE. <br />Due to the number of parties involved in. the consultation, FTA is executing the MOA in counterparts. <br />Therefore, you just need to: sign and return the: signature page for the party you represent.
