James CUP Staff Report November 2, 2021 <br />Gem Lake Planning Commission Page <br />Consolidated Land Use Ordinance Requirements <br />The required. setbacks for the RO zoning district are:. <br />• Front: 40 feet <br />• Sides: 15 feet <br />• Rear. 35 feet <br />The proposed structure would be able to meet.the front setback,. but would be encroaching into the side <br />setback from the south property line by 5 feet, and encroaching into the real- lot line off the west property <br />line by 10 feet. A variance would have to be issued to encroach into the required setbacks. Variances are <br />able to be .issued if a request. Meets. a certain set of criteria, which are outlined in Section 17.4 of the <br />ordinance. These criteria.at.e to determine if there. are 'practical difficulties' with the.lot that prevent the <br />applicant from. meeting the normally required standards. <br />ACTION <br />There is no action required of the Commission at this time; this report ismeant.to.make.the Commission <br />aware of a.potehtial upcoming .item for:a future. agenda.. <br />1. <br />
