SECTION 4 DESCRIPTION AND OPERATION OF THE MUNICIPAL SANITARY <br />SEWER SYSTEM. <br /> <br />Section 4.1 General Operation <br /> <br />Section 4.1.1 The entire Municipal Sanitary Sewer System , operated by the City of Gem <br />Lake shall be operated as a public utility and convenience from which revenues will be <br />derived. It is recognized that this sewer system might be available to only portions of the <br />city, and that it will serve only where individual sewage treatment systems are <br />unavailable or impractical. The Municipal Sanitary Sewer System operated by the City of <br />Gem Lake exists to serve the users of the system who have connected to this system. As <br />defined by the State Auditor, the accounting will be as an Enterprise Fund separate from <br />the General Fund of the City of Gem Lake. It is expected that the users of the system <br />shall pay for its construction, maintenance, any rebuilding or repairing needed and its <br />operation. <br /> <br />Section 4.2 Connection Required <br /> <br />Section 4.2.1 Any buildings used for human habitation or use and located on property <br />adjacent to a municipal sewer main, or in an area through which the system extends, shall <br />be connected to the Municipal Sanitary Sewer System within one (1) year if buildings are <br />commercial or ten (10) years if buildings are residential from the time a connection is <br />available to any such property. <br /> <br />Section 4.2.2 Any buildings used for human habitation or use and located on property <br />adjacent to a municipal sewer main, or in an area through which the system extends, <br />which have an IST S determined to be failing shall be connected to the Municipal <br />Sanitary Sewer System within six (6) months from the date said ISTS is determined to be <br />failing. <br /> <br />Section 4.2.3 All buildings constructed on property adjacent to a municipal sewer main <br />or in an area through which such system extends, shall be provided with a connection to <br />the Municipal Sanitary Sewer System for the disposal of all human wastes. <br /> <br />Section 4.3 Use Of Certain Buildings Restricted <br /> <br />Section 4.3(1) No person, firm or corporation shall use any building, nor allow any other <br />person to use such building, which building is not connected to the Municipal Sanitary <br />Sewer System as required by Section 4.2 of the Ordinance. <br /> <br />Section 4.4 Types Of Wastes Prohibited <br /> <br />Section 4.4.1 Except as herein provided, it shall be unlawful to discharge any of the <br />following described materials into the Municipal Sanitary Sewer System. <br />
