1.1 TERMS, The following terms, unless elsewhere defined specifically in the f <br />DEVELOPMENT CONTRACT, shall have the following meanings as set forth -below. <br />1.2 CITY. "CITY" means the City of Gem Lake, a. Minnesota murdeipal corporation. <br />1.3 DEVELOPER. "DEVELOPER" means The Luther Company, LLLP a Minnesota <br />limited liability, limited partnership. <br />1.4 OWNER. "OWNER" means The Luther Company, LLLP; a Minnesota limited <br />liability, limited partnership. <br />i.5 CONDITIONAL USE PERMIT. "CUP" means Conditional Use. Permit <br />approved. by the City for the: property comprising the real property located in Gera Lake, Ramsey <br />County, Minnesota and legally described on Exhibit D 1. <br />L6 DEVELOPMENT PLANS. "DEVELOPMENT PLANS" means all.the plans, <br />drawings, specifications, and surveys identified and checked on the attached. Exhibit D2, and <br />hereby incorporated by .reference and made a part of this DEVELOPMENT CONTRACT, <br />L7 DEVELOPMENT CONTRACT. "DEVELOPMENT CONTRACT" means this <br />contract by and among. the CITY,. OWNER, and DEVELOPER. <br />L& COUNCIL. "COUNCIL" means the Council.of the City of Gem Lake. <br />1.9 CITY ENGINEER. "CITY ENGINEER" means the CITY ENGINEER of the. <br />City of Gem Lake. <br />1.I0 COUNTY. "COUNTY" means Ramsey County, Minnesota. <br />.1,11 OTHER REGULATORY AGENCIES. ".OTHER REGULATORY <br />AGENCIES" meansand includes; 4ndividually and collectively, the following: <br />a.) Minnesota. Department of Transportation;. <br />b.) Ramsey County; <br />C.) Ramsey. Washington Metro Watershed District; <br />d.) Metropolitan Council, and <br />e.) City of Vadnais Heights. <br />f) any other regulatory or governmental agency or entity affected by, or having <br />jurisdiction over the DEVELOPER IMPROVEMENTS. <br />
