4.3 GROUND MATERIAL. The DEVELOPER shall ensure that adequate and � <br />suitable ground material :shall exist in the areas of public street and utility improvements and shall <br />guarantee the removal, replacement or repair of substandard or unstable. material. The cost of said <br />removal, replacement, or repair is the responsibility of the DEVELOPER. <br />4A GRADING/DRAINAGE PLAN AND EASEMENTS. The DEVELOPER shall <br />construct drainage facilities adequate to serve the CUP in accordance with the DEVELOPMENT <br />PLANS. The OWNER.and DEVELOPER agree to grant to.the CITY all necessary easements for. <br />the preservation of the drainage system, for drainage basins and for utility service. All such <br />easements required by the CITY shall be on. the CUP' or in writing; in .recordable form, and on the <br />standard easement form of the CITY, and on such other terms and. conditions as the CITY shall <br />determine; such easements shall be delivered to the CITY contemporaneously with execution of <br />this. DEVELOPMENT CONTRACT. The grading of the site shall be completed in conformance <br />with the DEVELOPMENT PLANS: Inthe event that the DEVELOPER fails to complete the <br />grading of the site in conformance with the. DEVELOPMENT PLANS by the stipulated date, the <br />CITY may declare the DEVELOPER in default pursuant.to Article 14. <br />4.5 BOULEVARD AND AREA RESTORATION. The DEVELOPER shall seed or <br />Iay cultured sod in all boulevards within 30 days of the completion of street. related improvements <br />and restore ail other areas disturbed by the development grading operation. in accordance with. the <br />approved erosion control plan; over the entire CUP, Upon request of the CITY ENGINEER, the. <br />DEVELOPER shall remove the gilt fences after grading and construction have occurred. <br />Furthermore,, the DEVELOPER shall maintain reasonable access to any occupied buildings <br />within the CUP, including necessary street maintenance such as grading, graveling, patching, and <br />snow removal prior to permanent street surfacing. The DEVELOPER agrees to perform and <br />assume all responsibilities relating to snow removal and ice contral.`The City of Gem Lake is not <br />responsible for any maintenance including sweeping, plowing, patching, seal coating; etc. until the <br />City extends the road in the future. <br />4.6. VEGETATION. The DEVELOPER shall comply with CITY ordinances related <br />to preservation. of vegetation and trees and. specifically ;shall exercise reasonable efforts in <br />residential areas to save mature., undiseased trees :and vegetation on the subject land which do not <br />have to be removed for reasonable installation of buildings; streets, utilities, or drainage <br />improvements,. construction activities related thereto, or site grading. Prior to any excavation;. the <br />DEVELOPER shall mark trees that are to. ba: saved. with.. a red band prior to any excavation, and <br />protect such trees by snow fences or other suitable enclosures. All diseased trees shall be removed <br />according to CITY ordinance requirements.. <br />4.7 LANDSCAPING, Site landscaping shall be in accordance with the <br />DEVELOPMENT PLANS. Within one (1) year after occupancy, each. lot shall have been either <br />seeded or sodded as shown on the DEVELOPMENT PLANS. <br />4.8 EROSION CONTROL: The DEVELOPER shall. provide and follow a .plan. for <br />erosion. control in accord with. the Best Management Practices (BMP} as delineated in. the <br />Minnesota Pollution Control Agency handbook. titled "Water Quality in Urban Areas."
