EXHIBIT D4 <br />MISCELLANEOUS REQUIREMENTS AND CONDITIONS <br />.IMPOSED BY THE CITY <br />1.) CONDITIONS TO BE SATISFIED BEFORE CITY RELEASES THE CUP <br />TO BE RECORDED. <br />a.) Letter of Credit. DEVELOPER must provide the letter of credit. for the amount <br />stated on Exhibit D5 of this DEVELOPMENT CONTRACT. <br />b) .inspection Fee Deposit.. DEVELOPER must provide to the City of <br />the cash deposit for inspection. fees stated.. on Exhibit D5 of the <br />DEVELOPMENT CONTRACT. <br />c.). Planning Fees. DEVELOPER must fully pay the City of Gem Lake for all planning, <br />engineering review, and legal fees that have been incurred. <br />2.) SUBDIVISION EROSION CONTROL.. DEVELOPER is responsible for <br />erosion control throughout the CLIP until f nal site stabilization. To assure proper erosion control, . <br />the DEVELOPER, in addition to the Letter of Credit for DEVELOPER IMPROVEMENTS, shall <br />post and the CITY shall retain the Engineering Security Amount and the Escrow Retainage <br />referenced in Exhibit D5. <br />5.) CLEAN UP OF CONSTRUCTION DEBRIS ON STREETS AND <br />ADJOINING PROPERTY. The security amount stated on Exhibit D5 shall include an. <br />appropriate amount as determined by the.City Engineer to assure that the DEVELOPER removes <br />any construction debris from streets adjoining the CUP and from. private properties. that. adjoin the <br />CUP. <br />
