3.2. Each. application for a license shall be accompanied. by the minimum proof of <br />financial responsibility required by Minnesota Statutes Section 340A.409 (subd. 1) and <br />any .amendments thereto. or substitutes therefor that may from time to time .become <br />effective. <br />3:3. The proof of financial responsibility offered under Subdivision. 2 shall be approved <br />by the: City Council and in the case of applicants for off.sale licenses by the State <br />Commissioner of Public Safety. Liability insurance policies shall be approved as to form <br />by the City Attorney. The operation of such off.. -sate or. on -sale liquor business without <br />having on file at all tunes with the inunicipality the proof of financial responsibility <br />required. in.Siibdivision 2..shall be..grounds for immediate.revocadon of the. license. <br />'Section 4. License .Fees. <br />4.1. Each application for a license shall be. accompanied by a receipt From the .City T <br />reasurer for payment in full of the required fee for the license.. Al l fees. shall be paid into <br />the general fund of the municipality. Upon rejection of any application for a license,the <br />treasurer shall refund the amount paid.. <br />4.2. All licenses shall expire on. the last day of December of each year. Each license shall <br />be issued for a period of one year except that if a portion of tie license year has elapsed <br />t. <br />when the application. is. made, a license inay be issued for the remainder of the: year for a pro rata fee. In computing such fee, an unexpired fraction of a month shall be counted as <br />P p g y p <br />one month. <br />4.1 (Repealed by Ordinance.94, adapted 2/10/2009). <br />4.4. No refund of any fee shall be permitted except as authorized udder Minnesota <br />Statutes, Section 340A.40. <br />Section. 5. Granting of Licenses. <br />5.1., The City Council shall investigate all facts set but in the application. Opportunity <br />shall be given to any person to be heard for or against the granting of the. license. After <br />such investigation and hearing, the City Council shall grantor refuse the application in its <br />discretion. N o "off sale" license shall become effective until it, together with the proof of <br />financial responsibility furnished by the. applicant, has been approved by the. State <br />Commissioner of Public Safety. <br />51. An applicant seeking an "on -sale" .license shall pay an :investigation fee with. the <br />required annual license fee. If investigation outside the State of Minnesota is.re.quired by <br />the city council or the State Commissioner of Public Safety, the: applicant. shall pay the <br />actual cost of the investigation, up to $19,00.a0, prior to any action to approve or deny <br />tl;e.iicense. <br />
