City of Gem Lake <br />Resolution No.: 28 <br />City,of Vadnais Heights <br />Resolution No.: <br />A JOINT RESOLUTION REQUESTING CONCURRENT DETACHMENT FROM <br />VADNAIS HEIGHTS AND ANNEXATION INTO GENVI LAKE OF CERTAIN LANDS <br />PURSUANT TO MINNESOTA STATUTES SECTION 41.4.061 <br />WHEREAS., certain real property., legally described in Exhibit A attached hereto and also <br />described as Parcel ID 343 02221 as l (the "Annexation Property"), is .located in Vadnais Heights, <br />and <br />WHEREAS, the Annexation Property is located on the border of Vadnais Heights. that is <br />contiguous to Gem Lake; and <br />WHEREAS, the Annexation Property is owned by DLW Properties, .LLC which consents <br />to the concurrent detachrnent from Vadnais Heights and annexation into Gezn Lake, and <br />WHEREAS.,. Vadnais Heights and Gem Lake want the entire Annexation Property to be <br />located in the corporate limits of Gem Lake; and <br />WHEREAS, Vadnais Heights and Gem Lake want to modify their mutual municipal <br />boundary to permit the Annexation Property to be located entirely within Gem..Lake; and <br />WH-EREAS, to modify the boundary, Vadnais Heights desires to detach and Gem Lake <br />desires to annex. the Annexation. Property pursuant to Minnesota Statute § 414.061. <br />NOW, THEREFORE, BE IT RESOLVEDO <br />1. The Cities. of Vadnais Heights and Gem Lake jointly request that the Minnesota Office of <br />Administrative Hearings, Municipal Boundary Adjustment Emit concurrently detach the <br />Annexation Property from. the City of Vadnais Heights and annex. the same to the. City of <br />Gem Lake at the earliest possible date. <br />2. The. City Attorney for. the City of Gem Lake is authorized to submit this resolution along <br />with appropriate application materials to the Minnesota Office of Administrative Hearings, <br />Municipal Boundary Adjustment Unit for the propose set forth herein. <br />
