Chapter-57ZB, except each party shall be responsible for. its own fees and <br />costs and one-half of the arbitrator's fees and expenses. <br />B) Either party shall have the right to terminate this Contract upomthe. occurrence <br />of any of the following events: <br />1.) If federal or state laws, regulations or a finial judicial decisions substantially <br />and adversely affect the rights, duties .or obligations ofeither party under this <br />Contract. Jrrthe.event of such terinitiation, the terminating party shall give the <br />other party as much noticeof such-canceflation as is reasonably possible <br />consistent with the law,. regulation or. judicial decision. <br />2) Either party fails to zdinply with an -award pursuant to paragraph A) above:. <br />3) Either party may terminate with -or without cause provided the terminating <br />party provides the non -terminating party with 90 days' written notice. <br />SECTION III <br />Financial Obligation of City of Gem Lake. <br />A) The, City. shall pay the Township for administrative services (Accounting. <br />Clerk/Receptionist, Building Inspector, Clerk -Treasures•,. Finance ArWyst.*and Officer, <br />Para Legal Secretary, Planner, Secretary -Receptionists, accarding-to the parties'* <br />agreement, the sum of $05.00 pet.hour, paid to the Township upon irivoice; The. <br />Township's fees will be.reviewed by the parties annually. <br />B) The City shall pay the Township for public works services (snow removal, street <br />sweeping,..street patching [asphalt], street tree trimming, street sealcoating; asphalt trail, <br />sanitary sewer (ine jetting, hydrant flushing, mowin' lain garden}; according to the <br />parties' agreement, the sum of $80.00 er hour, paid xo the Township upon invoice. The <br />Township's: fees will be reviewed by the parties annually: <br />SECTION IV <br />Best Efforts <br />The: Township shall respond to the.requests by the City using. best practices and <br />equipment that.are available:at the time of the request. There maybe an fficident. where. <br />the Township cannot-prope.rly respond to the request.
