Interim Conditional Use.Permit <br />Requirements <br />Hansen Investments, LLC. <br />Y= County Road E <br />Gem Lake, Minnesota 55110 <br />The City Council noted that future Interim Use Permits for the Garden Overlay District <br />must meet all Ordinance requirements as defined by Ordinance No. 122 - Garden Overlay <br />Zone.. They include submission of. <br />• Draft leases; contracts or use agreements. to which the group(s) or individual(s) <br />using the gardens agree to prior to using.the garden space. <br />■ Agreements must. provide the. land owner with the legal ability, to evict a tenant <br />and bar entry to any individual member of a group if the tenant violates the terms <br />of the Zoning Ordinance, the Interim Use Permit for the property, and restrictive <br />term of the lease or any other applicable City Ordinance or State law. <br />• The applicant shall provide a written summary of the proposed use of fertilizers, <br />pesticides, and other agricultural chemicals in the maintenance of the gardens. <br />■ No motorized implements or machinery may be used in the cultivation and <br />maintenance of any garden, except for. plowing of the plots between the hours of <br />8:00 a.m. and 5:00 p.m., Monday through Friday. Motor vehicles of less than <br />7,000 lbs. gross vehicle weight may be used to. deliver and carry away equipment, <br />supplies,.. and product. <br />• Animal husbandry and aquaculture are not permitted activities within. a Garden <br />Overlay zone. <br />■ No fuel, fertilizer, pesticides or similar chemicals shall be stored on the property: <br />s. All gardening activity and all. structures and equipment shall be set back at least <br />N feet from the property line of any property not. included within a Garden <br />overlay Zone, and at least 150 feet from any dwelling. <br />■ All gardens shall be.. divided. into garden plots, separate from other plots and from <br />required setback areas by unpaved walkways of at least b feet in width. No single <br />plat. shall cove.r more than 10% of the total land area of the property on which the <br />plot. is located. <br />• Off-street parking and loading areas shall be unpaved and, shall not exceed 15% of <br />the lot area covered by garden plots and required walkways. <br />• The property owner is responsible for the collection and disposal of litter on the <br />property. <br />• The hours of operation for a permitted garden are % hour before sunrise until <br />hour after sunset. <br />■ The property owner is responsible for ensuring compliance. with all other <br />applicable laws, ordinances and. regulations, including City ordinances and <br />watershed district rules governing wetlands and stormwater.control. <br />• The City reserves the right to periodically inspect the premises to insure <br />compliance. <br />Look for us on. the World Wide Web at.gemlakemn.org <br />
