MEMORANDUM <br />TO: <br />PLANNING COMMISSION <br />FROM: <br />TOM RIE©ESEL <br />©ATE: <br />MARCH 28, 2017 <br />SUBJECT: GARAGE ADDITION <br />REQUEST: CONDITIONAL USE PERMIT TO ALLOW CONSTRUCTION OF <br />AN ADDITION. TO A GARAGE <br />LOCATION: 3614 BIG FOX ROAD <br />APPLICANT: JUSTIN SHORT <br />ZONING: RX, EXECUTIVE RESIDENTIAL <br />Mr. Short is requesting approval of a Conditional Use Permit which would allow him to <br />construct a 30' x 34' addition onto his. existing garage. The garage is currently 30' x 34' W <br />1,020 square feet. The garage would be doubled in size to 2,040 square feet if the <br />Conditional Use Permit is approved_ The existing height of the garage will not be <br />increased. <br />City ordinances permit garages and accessary structures up to 1,000 square feet in area. <br />Larger structures may be. permitted by Conditional Use Permit. <br />Setback requirements for a structure are; 40 from the front right-of;way, 20' from the side <br />yard abutting; a street. (Co unty Road E), 15' from a side lot fine and 35' from the rear lot <br />line. <br />Mr. Short is: proposing to meet all setback requirements. The setback from County Road <br />E must be verified: Staff has requested the applicant to provide a site plan or survey which <br />shows the location of the addition in relation to the property line along County Road E. <br />Mr. Shorf''s current site plan shows. a 50' separation between the garage addition and <br />County Road E. That setback is measured from the pavement, however: The actual lot <br />line is approximately 15' from. the edge of the pavement. A lot corner at the southeast <br />corner of the property was observed. by staff. Based on an aerial photo, the existing <br />garage appears to be approximately 60' from the County Road E. <br />The. City permits garages/accessory structures which exceed 1.,OOQ' in area. by <br />Conditional Use Permit. Conditional Use Permits are. regulated by the Zoning Ordinance. <br />A Conditional Use Permit means the use is permitted but is subject to reasonable <br />conditions which are established by the City Council. Section 17.5 of Ordinance No. 43K <br />sets the requirements which must be reviewed when considering a. Conditional Use <br />Permit. In part it states: <br />
