Section 4.3 Boundaries <br />4.3.1 District boundary lines as indicated on said map follow lot lines, :the center lines of streets, <br />alleys, or railroads, the center lines. of streets or alleys projects., the center of water courses or the <br />corporate limit lines, all as they exist upon . the effective date of this Ordinance or anieridments <br />thereto. if district boundary lines do not follow any of the above. described lines, the district boundary <br />lines are established as drawn on the. zoning map.. <br />Where a District boundary line divides a lot of record which was in single ownership at the time of <br />enactment of this Ordinance and places portions of such lot of record in two (2) or more Use.Distriets, <br />any portion of such. lot with fifty (50'0").. feet on either side of such a dividing. district boundary line <br />may be used for any use of either Use District; provided, however; if any portion .of such lot shall <br />extend beyond the. fifty (50'0") feet limitation, the District line as shown shall prevail. <br />Appeals from the Zoning Administrator's determination and questions of doubt concerning the exact <br />location of District boundary lines shall be. heard by the. Board. of Appeals. <br />Q DELETIONS, ADDITIONS AND CHANGES IN DESCRIPTIONS OF <br />THE: CITY OF GEM LAKE RESIDENTIAL ZONING DISTRICTS TO <br />AGREE WITH THE 2008 AND :2013 COMPREHENSIVE PLAN <br />1) The existing Section 5 "R1" will be deleted and. the following new district <br />description . added in place of the existing: <br />SECTION 5 - SINGLE FAMILY ESTATE "RE".DISTRICT <br />The minlinum lot size in the "RE" planning acres is 5 acres, but most of the existing "estates' are located <br />on. land parcels much larger than 5 .acres.. All but one of the parcels mapped as "estate" are built upon and <br />are not expected to be subdivided or re -developed in. the near future. This 5 acre minimum. lot size. plan <br />allows for land transfers from. the least derise land category to a classification that allows for denser <br />development. However, it. is important to note that the Gem ,Lake Comprehensive plan does nat.project <br />or assume any immediate change in the existing pattern of development on these properties. <br />When;.in the.future, this land is .sub -divided it is .possible. to also have some "RS" development along the <br />perimeter throughfares of the "RE" area to provide diversity of housing, <br />Principal and accessory buildings should be located, in this area, so as. to allow for possible future <br />subdivision to "RK" or "RS Tots.
