City of Gem Lake <br />Ramsey County, Minaesota <br />Temporary Ordillance Nun-iber 1.28 <br />AN INTERIM ORDINANCE PURSUANT TO MINNEESOTA STATUTES SECTION 462.355, <br />SUBDIVISION 4, TO ESTABLISH A MORATORIUM PROHIBITING THE GRANTING OF <br />PRELIMINARY SUBDIVISION APPROVAL,. ZONING (CUP VARIANCE) APPROVAL, <br />REZONING, OR PC.UD APPROVAL WITHIN THE MORATORUM AREA AS DEFINED <br />HEREIN. <br />Section 1. Purpose and Intent: The City Council on February 22" a.2016, formed a committee to <br />review the City's ordinances with the intent to update them as to whether they fulfill the <br />underlying. purposes of the City's land use and zoning provisions, and prepare them for the 2618 <br />Comp Plan. <br />Section 2. Moratoriuni Area: Real property West of`liighway 61. Cast of Big Fox Rd, North of <br />County Road E, South of 21 Daniels Farm Ad, South of 19 Daniels Farm Rd and South of 3 <br />Daniels Farm.Rd in the City of Gem Lake. <br />Section 3. Restrictions: No approval shall be granted for Subdivision, Zoning (CUP Variance), <br />Rezoning, or PUD approval. for any property within the Moratorium. Area. <br />Section 4, :Duration- This Ordinance shall expire twelve months of the passage of this <br />Ordinance by the City Council or it may be repealed earlier if the Council determines that the <br />appropriate ordinances have been updated and the zoning codes have been finalized. This <br />Ordinance maybe extended by adoption not to exceed the.statutory limits in Minn. Stat. 462.355., <br />subdivision 4. <br />Section 5. Variance: The. Council may grant a variance to this Ordinance if the Council finds. <br />after careful review of all the facts, that a proposal is not contrary to the intent of the 2018 <br />Comprehensive Plan, that it is compatible with the: zoning and. official control amendments being <br />considered by the City; that it does not adversely impact the health, safety or welfare of the <br />citizens and that it otherwise meets the requirements of the City of Gem Lake and state law. <br />Adopted by the City Council of The City of Gem.
