Sewage <br />Treatment System (SSTS) program. The Minnesota Pollution .Con.troI Agenry (MPCA�.has.n❑ official <br />record of an. adopted ordinance bj+your city or.towrnship derrlonstrating that: it is as strict as the coun.ty's <br />current SSTS Ordinance. <br />Minnesota Statute § 115:55, subd; 2, (a) requires. all :counties to amend .their ordinance to include the. <br />2014 MPCA SSTS rules by February 4, 1014. The law aliow.s cities and townships.to regulate septic <br />systems, i.f they choose to. do so. The: law.stotes that county ordinances must apply to all areas of the <br />county other than cities or towns that have. adopted a SSTS ordinance. City and township ordinances <br />must be as strict as the county ordlnance..Further, city and township ordinances must. be adopted within <br />one yearafter'the.:county adoption date. 1f a township or city decides not to adopt an ordinance, the <br />county Is then. responsi.bie for administering and enfprcing.the ordinance. <br />Attached to.this. letter is. a factsheet which identifies the main legal, technical, and administrative <br />:capabilities that cities. and townships roust have to implement their own SSTS program. Pleasetake time <br />to review the .facts heet to understand the necessary requirements for all local SSTS prbgrams. <br />At this time, we are asking each city and township receiving this letter. to state their intention in <br />irnplernenting a 5ST5. program wltich.meets their.current. County Ordinance.. Please provide a written <br />response to the MPCA by October. 17, 2014. if you indicate that you wilt not be implementing a.SSTS <br />program, your county will be assuming responsibility for your city or town shlp: <br />IF your lurisdiction has met SSTS program re.quirements,.please convey that, in writing, to the MPCA. <br />Please include a copy of your ad.op.ted SSTS ordinance with your correspondence to the MPCA. <br />If you.cho.ose to continue the 5ST5 program and have. not adopted .a SSTS .ordinance, it roust be adopted <br />within one year after county adoption and it rrlyst be as strict, or rho re. restrictive, as the county <br />ordinance. 1f the one. year time period has -already expired,: the county ordinance. is technically in effect. <br />However, the MPCA Is willing to aIlow cities and tow nships, currently past. the doe date,. to complete <br />their ordinance by December $1., 2014. <br />Not.responding to this letter; .not adopting.a new S$T5 ordinance, no:t.submittlog the required annual <br />report,. or not meeting the miniirnurn requirements of a 5ST5. program wiil autarriatically void the city or <br />township of the legal authority to administer a SSTS program. The result is -that the county will be the <br />responsible unit cfgovern ment for SSTS in yourjurisdiction. <br />
