A property owner may request a variance from the standards. as specified in this <br />Ordinance pursuant to the requirements provided in Mianwola. State Statutes.. The City shall <br />consider the requirements of Minnesota Rules Chapter. 7082.0300, !mbd. 2 and 3 when <br />considering such variances. Variances. that. pertain to the standards and requirements of the State <br />of Minnesota inust be approved by the of£ected.State Agency.pvrsuant to the requirements of the <br />State. Agency. <br />Sec. 21 -PERMIT REQUIRED <br />It is unlawful .for any person to construct, instmil, modify, replace, .or operate a SSTS <br />without the appropriate permit from the Department. The issuing .of..any permit; variance; or <br />conditional use. under the provisions of this. Ordinance .shall not absolvethe .applicant of <br />responsibility to obtain arty other required permit. <br />Sec. 22 - CONSTRUCTION PERMIT. <br />A construction permit shall be:obiained by.the property owneror an agent of the property <br />owner from the Department. prior to the installation; construction, replacement, modification, <br />alteration, repair, or capacity expansion of a SSTS. The purpose.of.this permit is to ensure that <br />theproposed construction activity is sited, designed, and constructed in accordance with the <br />provisions of this. Ord 1nerice by:appropriately certified and/or licensed practitioner(s), <br />(a) Activities Requiring a.Construction Permit <br />A' construction permit isrequired for installation of a new SSTS; for replacement pf an. <br />existing SSTS, or for any .repair ❑r replacement .of components that. will alter .the original <br />function. of the system, change the treatment capacity of the system, change the location of the <br />system, or otherwise ebange the. original systern 5s design, layout, or function. <br />(b) ,Activities Not Requiring a Permit: <br />Formatted: Fp[]t:.
