(.1) Whenever. a conveyance of land including a structure that is required to have a SSTS <br />occurs, _whicii__inelurlcs�properoi foreclosures and tLx rorfeited lransfers,. the following <br />requirements shall be. met: <br />a. A compliance inspection shall have been. perforned.and .a Certificate of.Compliance. <br />shall have been submitted to the Department within three (3) years for SSTS.older than five <br />years or. within five (5). years 1f the system is less. than five years old,. prior to the intended salt or <br />transfer of the property, unless evidence is found identifying,the. SSTS as an rraminent Threat to <br />-Public.He.alth. and Safety or Failing io ProtectCrroundwater. <br />b. The compliance. inspection must have been .performed: by a. service provider Or <br />auaiified employee gt}aii ei pl ie een ed4nspeetlen bu4fles <br />following procedures described in Section 26. <br />c. The seller of the property must disclose in writing infortnation about .the status and <br />location of a11-known SSTS on the property to the buyer on a form .acceptabId to the Department. <br />d; If the seller fails to. provide a Certificate of Compliance,. the .seller shall provide. the <br />buyer sufficient security in the Corm of an escrow agreement to assure the installation of a <br />compliant. SSTS. The security shall be placed in an escrow with a licensed real estate .cltiser, <br />Iicensed attorney- at- law, or Federal of State chartered .fnancial,institution. The: amount escrowed <br />shall be equal to one hundred fifty. percent (ISQ%u) of a written estimate to install a compliant <br />SSTS as provided : by. a Iicensed SSTS.instalter, ❑r the amount escrowed shall be equal to. one <br />hundred ten percent (l 1004) of the written contract price for the installation of a compliant SSTS <br />provided by a licensed SSTS installer. After a. compliant SSTS has been installed and a <br />Certificate of Compliance issued, the Dep.artment.shall provide the escrow agent: :A. copy of the <br />Cerdfiaate.of Compliance.
