CITY OF GEM LAKE <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />RESOLUTION NO. 2026-02 <br /> <br /> <br /> <br /> <br />RESOLUTION OPTING TO NOT WAIVE LIMITED TORT LIABILITY FOR 2026 <br /> <br /> <br />WHEREAS, the City of Gem Lake has an option to waive it protection under the tort liability limitation <br />contained in Minnesota Statutes 466.04; and <br /> <br />WHEREAS, the statutory tort limits for 2026 are $500,000 per individual with a maximum of $1,500,000 <br />for a single occurrence; and <br /> <br />WHEREAS, the City of Gem Lake has opted not to waive its rights to limited tort liability in past years <br />and is required to make a declaration of its intention every year; and <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City of Gem Lake City Council of the City of Gem <br />Lake, Minnesota, that the City does not waive the monetary limits on municipal tort liability <br />established by Minnesota Statute 466.04 for 2026. <br /> <br /> <br /> <br />The motion for adoption of the foregoing Resolution was duly proposed by Councilmember Lindner and <br />seconded by Councilmember Cacioppo, and upon vote being taken thereon, the Resolution passed with a <br />vote of 5 in favor and 0 against. <br /> <br />Whereupon said Resolution was declared duly passed and adopted by the City Council of the City of Gem <br />Lake, on January 20, 2026. <br /> <br />BY: ATTEST: <br />Gretchen Artig-Swomley <br />Gretchen Artig-Swomley, Mayor Barbara Suciu, City Clerk <br /> <br />
