<br />4200 Gem Lake Road <br />Gem Lake, MN 55110 <br />(651) 747-2790 <br />city@gemlakemn.org <br /> <br />MEMORANDUM <br /> <br />To: Gem Lake City Council <br />From: Barbara Suciu, City Clerk <br />RE: Ordinance 83 Revisions <br />Date: April 16, 2026 <br />At the March 17, 2026, City Council meeting, the council was presented with proposed changes <br />to Ordinance 83 – Housing Code. The City Council asked that the Planning Commission, City <br />Attorney and Building Official review the revisions. <br />The Planning Commission met on April 7 and discussed the revisions. They didn’t have any <br />concerns about the proposed changes but were happy there were guard rails in the ordinance in <br />case of any discrepancy with the Minnesota State Building Code. <br />The City Attorney responded with adding the proposed language “Any hearing for denial, refusal <br />to renew, revocation, or suspension of a rental dwelling license, or for the imposition of <br />reasonable conditions or restrictions, shall be heard by the city council. The applicant for the <br />rental dwelling license shall be given 30 days’ notice of the hearing before the city council.” He <br />also suggested adding language about an appeal period and whether the appeal would go to <br />district court of the court of appeals. <br />The Building Official has not provided any feedback as of this publication. <br />Staff checked with the City of Willernie about the reasoning for such a restrictive rental code and <br />they were experiencing many of the houses in their city becoming rentals and wanted to regulate <br />that trend. <br />This item will be brought back to the City Council at their May 19 meeting for adoption. <br /> <br /> <br />
