CITY OF GEM LAKE, MN <br />4200 Otter Lake Road <br />Gem Lake, MN 55110-3227 <br />Telephone 651-747-2790 <br />E-mail Ci1y6t 4emlakcl%-I l.orQ <br />Application for Renewal of Liquor License <br />Type of License Applied for <br />On -Sale Liquor License Sunday O <br />M I License <br />ale Liquor <br />To The Mayor and Council of the City of Gem Lake: <br />Wine License <br />Pursuant to the provisions of the Minne ota Intoxicating Liquor Act and <br />Ordinances of the Cit of Gem Lake,i'+�l Lt LLC with principal <br />offices located at fl� SC N, , hereby applies for renewal of a <br />Liquor License for the period commencing first on the JS day of 21 , <br />2013, and ending last on the 31 st day of December, 2013 , to sell in oxicatiihg <br />liquors as defined by law at retail only for consumption "On The Premises" at <br />theC-64i)A}{►C(S CtO0 tlocated at WVA-�'C.I��t.N ,,, JQA— in the City of Gem <br />Lake, which the applicant controls and operates, and to that end hereby <br />represents and states as follows: <br />(1) Gem Lake is an incorporated city which has a population in excess of three (300) <br />hundred and which does not maintain an exclusive liquor store; and, <br />(2) The premises for which the applicant seeks renewal of a license is an establishment <br />having a resident proprietor and manager and a room with appropriate tables and <br />chairs for serving not less than thirty (30) guests at one time in which food is served; <br />and, <br />(3) On Sundays, intoxicating liquor will be served only between the hours of 12:00 <br />(noon) p.m. and 12:00 (Midnight) a.m., and only in conjunction with the serving of <br />food; and, <br />(4) The applicant is a Minnesota corporation and has not been convicted of any willful <br />violation of any law of the United States, or of the State of Minnesota, or of any local <br />Ordinance, with regard to the manufacture, sale, distribution, or possession for <br />distribution for sale of intoxicating liquors, and no license issued to the applicant <br />under the provisions of the Minnesota Intoxicating Liquor Act has ever been revoked; <br />and, <br />(5) No manufacturer or wholesaler will own or control, or has any financial interest in, the <br />business of selling intoxicating liquors at retail on said premises, nor power to exact <br />or require the applicant, by contract, understanding or otherwise, to handle or sell <br />only the products of such manufacturer or wholesaler; and, <br />(6) No other retailer's license has been issued, directly or indirectly, to the applicant or <br />for said premises other than a cigarette license; no license of a class other than <br />hereby applied for has been issued to any person at said premises; and said <br />premises are neither owned nor controlled by any person to whom no license could <br />be issued; and <br />(7) Said premises are not within any area within which the sale of non -intoxicating <br />liquors is prohibited by the laws of the State of Minnesota, the provisions of any <br />charter, ordinance, or special law, or through zoning ordinances, proceedings, or <br />legal process regularly held for that purpose; and <br />(8) The, applicant hereby agrees that any license granted pursuant hereto shall be <br />nontransferable without consent of the Gem Lake City Council; that said license shall <br />Look for us on the World Wide Web at gemlakemn,org <br />
