1/18/2011 <br />Four Seasons Conditional Use Permit: The probation period (90 days) has expired and up <br />for review by the city council. Mayor Uzpen stated that during the months of November and <br />December the cars were in compliance of the Conditional Use Permit. However, in January <br />the cars were not parked where they should be and Mr. Newcomb stated that was due to the <br />snow plowing of the car lot. At this time, the Four Seasons Auto Repair partner has left the <br />business. Mayor Uzpen stated that Mr. Newcomb would have to reapply for a new <br />Conditional Use Permit as the original permit was for two businesses on the property with <br />two partners. Mr. Newcomb feels the original permit covers both businesses and he will do <br />auto repairs on the cars he sells. Councilmember Rasmussen stated going forward; the <br />council can revisit this issue. There are some hot tubs on the property left from the departing <br />partner that need to be removed, and the property needs to be cleaned up. Mr. Newcomb will <br />give a 30-day notice to the partner to remove the hot tubs from the property. Upon motion, <br />Councilmember Rasmussen voted to remove the 90-day probation and reinstate the <br />Conditional Use Permit, and it was seconded by Councilmember Lindner. Councilmember <br />Lindner stated the city council would have to revisit this issue in the near future. Mr. <br />Newcomb will work with T <br />10/19/2010 <br />Mr. Wilson asked the council what the normal procedure was for any violation of <br />the Conditional Use Permit. Councilmember Artig-Swomley explained that the <br />council has never experienced a violation of a Conditional Use Permit. Mr. <br />Newcomb explained to the council that it is hard keeping two cars on County <br />Road E and two cars on Schedumann Road due to the car auctions delivering <br />cars and test-driving of cars being left in front. He stated that when he asked for <br />the permit his count was ten cars for sale and the council allowed a maximum of <br />four cars in front, two on County Road E and two on Scheuneman Road. Mr. <br />Newcomb knows that he was in violation and wants to modify the permit to allow <br />six cars in front. Mayor Uzpen explained that it is a strip mall, not a car lot and <br />they are limited spaces for each storefront. The City Council and Mr. Newcomb <br />agreed to two cars on County Road E and two cars on Scheuneman Road. That <br />was why the City Council agreed to the Conditional Use Permit. Councilmember <br />Rasmussen discussed the violation with Mr. Newcomb and explained that there <br />are 24 cars and the used car business would be done in the back with the few <br />cars up front to draw people in. Councilmember Linder asked Mr. Newcomb <br />what is the time frame is on the turnaround of a car. Mr. Newcomb said it is <br />about a thirty to sixty day turnaround. Councilmember Bosak spoke to Mr. <br />Newcomb about how he is going to change as he has violated the Conditional <br />Use Permit numerous times. Mr. Newcomb stated he would not violate the <br />permit anymore. <br />9/21/10 <br />Four Seasons Conditional Use Permit: There have been violations of the Conditional Use <br />permit on a weekly basis. The City Council will have a Public Hearing in October and will <br />send out a letter stating that the Conditional Use permit will be revoked. <br />
