SECOND AMENDMENT <br />TO <br />JOINT SERVICES AGREEMENT <br />BETWEEN THE TOWN OF WHITE BEAR <br />AND THE CITY OF GEM LAKE <br />THIS AMENDMENT AGREEMENT, made as of this day of <br />February, 2010, by and between the TOWN OF WHITE BEAR (the Town), a <br />statutory township of the State of Minnesota, and the CITY OF GEM LAKE (the <br />City), a Minnesota municipal corporation, <br />WHEREAS, the Town and the City have an active Joint Services <br />Agreement between them which has been in effect and annually renewed since <br />January 22, 2007, <br />WHEREAS, a First Amendment to that certain Agreement was executed <br />by both parties on January 20, 2009, <br />WHEREAS, the Town desires to amend the fees for services outlined in <br />Appendix A of the original Agreement, <br />WHEREAS, Minnesota Statutes, Section 471.59, provides that a <br />governmental unit may enter into an agreement with another governmental unit <br />to provide services or perform functions on its behalf, provided that the services <br />or functions are those which the providing governmental unit is authorized to <br />provide for itself, <br />NOW, THEREFORE, in consideration of the mutual undertakings herein <br />expressed, the Town of White Bear and the City of Gem Lake agree to amend <br />their Joint Services Agreement — Appendix A as attached. <br />The parties hereby affirm that the Joint Services Agreement Between the <br />Town of White Bear and the City of Gem Lake, dated January 22, 2007, and First <br />Amendment dated January 20, 2009, and Appendix A as amended herein, is the <br />entire Agreement between the parties. <br />NITNESS WHEREOF, the parties have caused this Second <br />t t'b, 4 my executed as of the date and year written below. <br />TARDRIC <br />W BEA <br />A.
